EKSISTENSI LEMBAGA NON STRUKTURAL YANG DIBENTUK OLEH PEMERINTAH DAERAH DAERAH ISTIMEWA YOGYAKARTA (Studi Latar Belakang Pembentukan dan Konsep Penataan Lembaga Non Struktural)

Penelitian ini memiliki 3 (tiga) tujuan yaitu untuk mengetahui faktor yang melatarbelakangi pembentukan LNS di Pemda DIY, menganalisis dan mengetahui faktor yang menyebabkan dasar hukum pembentukan LNS bervariasi dengan derajat independensi yang berbeda, dan mengetahui langkah yang tepat dalam rangka melakukan penataan LNS yang dibentuk oleh Pemda DIY. Jenis penelitian yaitu penelitian normatif dan bersifat deskriptif. Jenis data yang digunakan yaitu data sekunder yang dikumpulkan dengan studi kepustakaan dengan cara mengkaji dokumen-dokumen atau bahan-bahan hukum, baik bahan hukum primer, bahan hukum sekunder, maupun bahan hukum tersier yang berkaitan dengan masalah hukum yang diteliti. Berdasarkan penelitian yang dilakukan penulis, terdapat 3 (tiga) kesimpulan. Pertama, ada 6 (enam) faktor yang melatarbelakangi pembentukan LNS di Pemda DIY yakni konsekuensi Undang-Undang Nomor 13 Tahun 2012 tentang Keistimewaan DIY, amanat pemerintah pusat, kebutuhan daerah, euforia desentralisasi, upaya memotong rantai birokrasi, dan PD dan UPTD yang belum optimal melaksanakan tugas dan fungsinya. Kedua, ada 4 (empat) faktor yang menyebabkan LNS di Pemda DIY dibentuk dengan dasar hukum yang bervariasi dengan derajat independensi yang berbeda yaitu tidak ada pedoman pembentukan LNS, dasar hukum pembentukan LNS sangat dipengaruhi oleh para penyusun kebijakan, ketidakjelasan dan ketidakseragaman amanat peraturan perundang-undangan, dan warisan masa lalu. Ketiga, langkah yang dapat dilakukan untuk menata LNS di Pemda DIY yaitu memberikan definisi LNS yang seragam untuk kemudian menjadi kriteria untuk penataan LNS. Menurut penulis, terdapat 4 (empat) kriteria LNS yaitu berkedudukan di luar perangkat daerah, bersifat independen, melaksanakan tugas dan fungsi yang yang bersifat spesifik, berkedudukan serta bertanggungjawab langsung di bawah Gubernur. Penataan LNS berujung pada 2 (dua) hal yaitu LNS yang telah ada dipertahankan atau dibubarkan.

This study has 3 (three) objectives, to determine the factors of Non Structural Agency (NSA) establishment in The Local Government of Yogyakarta Special Region, to analyze and to determine the factors that cause the variations of NSA establishment legal basis with different types of independence, and to determine the right methods in order to organize the NSA which is established by The Local Government of Yogyakarta Special Region. The methods used in this study is normative and descriptive research. The type of data used is secondary data which is collected by literature study by reviewing legal documents or materials, both primary legal materials, secondary legal materials, and tertiary legal materials related to the legal issues under study. Based on the research conducted by the author, there are 3 (three) conclusions. First, there are 6 (six) factors of NSA establishment in The Local Government of Yogyakarta Special Region. The consequences of Law Number 13 of 2012 concerning the Privileges of Special Region of Yogyakarta, the mandate of the Central Government, the regional government needs, the euphoria of decentralization, the efforts to cut bureaucratic chains, also PD and UPTD that are not optimal in carrying out its duties and functions yet. Second, there are 4 (four) factors that cause NSA in The Local Government of Yogyakarta Special Region to be formed with variety of legal basis with different types of independence, those are there is no guideline of the NSA establishment, the legal basis for the NSA establishment is strongly influenced by policy makers, the uncertainty and differences from the mandate of statutory regulations, things that are still going on from the past. Third, things that can be done to organize NSA in The Local Government of Yogyakarta Special Region are to provide the clear definition of NSA which later becomes the criteria for NSA structuring. According to the author, there are 4 (four) criterias of NSA, those are being excluded from the regional apparatus, being independent, carrying out specific tasks and functions, being responsible directly under the Governor. The NSA structuring will ends up to one of these 2 (two) things, whether the NSA is going to be remained or it will be disbanded.
