PERAN DEWAN KEHORMATAN NOTARIS DALAM PENEGAKAN KODE ETIK NOTARIS DI KABUPATEN GUNUNGKIDUL

Tujuan penelitian ini untuk mengetahui dan menganalisis peranan Dewan Kehormatan Notaris Daerah Gunungkidul dalam melakukan penegakan kode etik guna menjaga kehormatan profesi Notaris, untuk mengetahui dan menganalisis bentuk-bentuk pelanggaran oleh Notaris terhadap Kode Etik Notaris, dan mengetahui proses pengawasan terhadap Notaris agar tidak sampai terjadi pelanggaran kode etik di Gunungkidul. Jenis Penelitian ini adalah penelitian hukum normatif empiris yang dilengkapi dengan data kepustakaan dan dilengkapi data yang diperoleh langsung dari hasil wawancara dengan narasumber. Pendekatan normatif digunakan untuk menganalisis berbagai peraturan perundang-undangan terkait dengan permasalahan hukum yang diteliti. Pendekatan empiris digunakan untuk menganalisis hukum yang dilihat sebagai perilaku Notaris dalam menjalankan profesinya di Kabupaten Gunungkidul. Berdasarkan hasil penelitian Peranan Dewan Kehormatan Notaris Daerah dalam melakukan penegakan Kode Etik Notaris di Gunungkidul dapat dikatakan sudah cukup baik namun belum maksimal, sehingga masih diperlukan peran aktif Dewan Kehormatan Daerah dalam melakukan sosialisasi tentang Kode Etik Notaris kepada masyakarat, sehingga pengawasan terhadap jabatan Notaris khususnya terkait kode etik yang terkait dengan hubungan masyarakat. Dengan terlibatnya unsur masyarakat, diharapkan proses pengawasan terhadap Notaris dapat berjalan lebih maksimal sehingga kode etik dapat dilaksanakan dengan baik sebagaimana yang telah diatur di dalam Bab III Pasal 3, 4 dan 5 Kode Etik Kongres Luar Biasa Ikatan Notaris Indonesia (INI) di Banten pada tanggal 30 Mei 2015

The aim of this research is to discover and analyze the role of the Gunungkidul Regency Notary Honor Council in enforcing the code of ethics in order to maintain the honor of the Notary profession, the forms of Notary Code of Ethics violations done by Notaries and the process of supervision of Notaries so that code of ethics violations do not occur in Gunungkidul. The type of this research was empirical normative legal research. It was complemented by literature data and data obtained directly from interviews with resource persons. The normative approach was employed to analyze various law regulations related to the legal issues researched. While an empirical approach was employed to analyze the law seen as the notary behaviour in carrying out his profession in Gunungkidul Regency. Based on the research result, the role of the Regional Notary Honor Council in enforcing the Notary Code of Ethics in Gunungkidul could be said to be good enough. However, it was far from excellent. Thus, the active role of Regional Honor Council is still needed in disseminating the Notary Code of Ethics to the public. It is done so that supervision of the Notary position related to code of ethics is connected to the public. With the involvement of the public element, it is hoped that the supervision process of Notaries can be more optimal to the extent of the code of ethics can be implemented properly as stipulated in Chapter III Articles 3, 4 and 5 of the Code of Ethics in the Extraordinary Congress of the Indonesian Notary Association (INI) in Banten on May 30th, 2015. In addition, the Regional Notary Honor Council personnel, who only consisted of fellow active Notaries, are considered to have the potential of causing reluctance to impose strict sanctions on fellow Notaries in the event of a Notary Code of Ethics violation.
