Perlindungan Hukum Hak atas Pendidikan bagi Pekerja Anak dalam Sektor Informal di Indonesia Ditinjau dari Hukum Hak Asasi Manusia Internasional

Tujuan pertama dari penelitian ini adalah mengetahui dan menganalisis perlindungan hukum hak atas pendidikan bagi pekerja anak dalam sektor informal ditinjau dari hukum hak asasi manusia internasional. Tujuan kedua mengetahui dan menganalisis implementasi perlindungan perlindungan hak atas pendidikan bagi pekerja anak dalam sektor informal di Indonesia. Penelitian ini berjenis penelitian yuridis normatif dengan cara melakukan telaah atas data sekunder berupa bahan hukum primer dan bahan hukum sekunder. Hasil penelitian menunjukkan bahwa perlindungan hak atas pendidikan telah diatur dalam Universal Declaration of Human Rights, International Covenant on Economic, Social and Cultural Rights, International Covenant on Civil anf Political Rights dan Convention on the Rights of the Child sebagai hak dasar yang harus dihormati, dilindungi dan dipenuhi. Mengenai perlindungan hak atas pendidikan bagi pekerja anak, secara khusus diatur dalam Konvensi International Labour Organization No. 138 dan Konvensi International Labour Organization No. 182, yang menetapkan batas usia minimum bagi anak untuk boleh bekerja yang tidak lebih rendah dari usia menyelesaikan pendidikan wajib serta memberikan perlindungan bagi anak dari bentuk-bentuk pekerjaan terburuk bagi anak yang dapat mengganggu pendidikan anak. Namun realita di lapangan menunjukkan adanya pekerja anak usia 10-17 tahun di Indonesia yang tidak bisa mengenyam pendidikan akibat adanya hambatan berupa biaya pendidikan yang tidak terjangkau bagi masyarakat yang lemah secara ekonomi, sehingga Pemerintah Indonesia belum bisa mewujudkan kriteria aksesibilitas dalam pendidikan bagi pekerja anak. Berdasarkan indikator hasil, Pemerintah Indonesia terbukti melakukan pelanggaran terhadap ICESCR dibuktikan dengan terabaikannya pemenuhan hak atas pendidikan bagi sebagian pekerja anak.

The first purpose of this research is to find out and analyze the legal protection of the right to education for child labour in the informal sector reviewed from international human rights law. The second goal is to know and analyze the implementation of the protection of rights to education for child labour in the informal sector in Indonesia. This research is a type of normative juridical research by reviewing secondary data in the form of primary legal materials and secondary legal materials. The results show that the protection of the right to education has been set out in the Universal Declaration of Human Rights, International Covenant on Economic, Social and Cultural Rights, International Covenant on Civil anf Political Rights and Convention on the Rights of the Child as a basic right that must be respected, protected and fulfilled. Regarding the protection of the right to education for child labour, it is specifically set out in Conventions of International Labour Organizations No. 138 and Conventions of International Labour Organizations No. 182, which sets a minimum age for children to be allowed to work that is no lower than the compulsory education completion age and provides protection for the child from the worst forms of employment for the child that may interfere with the child's education. However, the reality in the field shows that there are child labour aged 10-17 in Indonesia who can not get education due to barriers in the form of unaffordable education costs for economically weak people, so the Government of Indonesia has not been able to realize accessibility criteria in education for child labour. Based on the outcome indicators, the Government of Indonesia is proven to be in violation of ICESCR due to neglect of the fulfillment of the right to education for some child labour.
