ANALISIS PRO-KONTRA KEBIJAKAN REKLAMASI TELUK BENOA DI PROVINSI BALI

Penerbitan SK Gubernur Bali Nomor 2138/02-C/HK/2012 dan Perpres 51 Tahun 2014 menimbulkan pro-kontra dari berbagai kalangan. Penelitian ini bertujuan untuk mengetahui proses penyusunan SK 2138/02-C/HK/2012, mengetahui kejanggalan yang terjadi dalam penyusunan SK 2138/02-C/HK/2012, dan mengetahui faktor penyebab perubahan peraturan zonasi di kawasan Teluk Benoa dalam Perpres No. 51 Tahun 2014. Penelitian ini menggunakan metode pengumpulan data studi literatur dan wawancara mendalam kepada sejumlah key informant yang mewakili pemerintah, masyarakat terdampak, akademisi dan LSM. Metode analisis yang digunakan adalah analisis pada setiap proses kebijakan publik. Hasil penelitian menunjukkan penyusunan SK Gubernur Bali Nomor 2138/02-C/HK/2012 tidak memenuhi standar tata kelola kebijakan yang baik dan ditemukan sejumlah kejanggalan seperti kurangnya transparansi pemerintah, terdapat pelanggaran sejumlah peraturan perundang-undangan, dan ada upaya mengaburkan maksud proyek dengan menggunakan istilah �revitalisasi�. Sementara itu, perubahan Perpres disebabkan karena kawasan Teluk Benoa dianggap sudah tidak sesuai sebagai kawasan konservasi perairan, namun ada maksud memuluskan proyek reklamasi di Teluk Benoa.

The issuance of the SK 2138/02-C/HK/2012 and Perpres 51/2014 raised pros-cons from various groups. This study aims to determine the process of drafting SK 2138/02-C/HK/2012, knowing the irregularities that occurred in the preparation of SK 2138/02-C/HK/2012, and knowing the factors that cause changes in zoning regulations in the Benoa Bay area in Perpres 51/2014. This research uses literature study and in-depth interviews with a number of key informants representing the government, affected communities, academics and NGOs. The analytical method used is the analysis of each public policy process. The results showed that the preparation of SK 2138/02-C/HK/2012 did not meet the standards of good policy governance and found a number of irregularities such as lack of government transparency, violations some regulations, and efforts to obscure the project's intent by using the term "revitalization". Meanwhile, the changes to the Perpres were due to the fact that the Benoa Bay area was deemed unsuitable as a marine conservation area, however, there was an intention to smoothen the reclamation project in Benoa Bay.
