PERJANJIAN KERJASAMA REKANAN ANTARA NOTARIS DENGAN BANK RAKYAT INDONESIA KANTOR CABANG YOGYAKARTA KATAMSO DITINJAU DARI KODE ETIK NOTARIS DI KOTA YOGYAKARTA

Tesis ini bertujuan untuk mengetahui, mengkaji dan menganalisis 1) Permohonan untuk menjadi notaris rekanan Bank BRI Kantor Cabang Yogyakarta Katamso termasuk melanggar Kode Etik Notaris. 2) Peran Dewan Kehormatan Notaris Daerah Kota Yogyakarta dalam rangka pencegahan dan penegakan Kode Etik Notaris. 3) Solusi penyelesaian dalam permasalahan perjanjian kerjasama rekanan antara notaris dan Bank Rakyat Indonesia Kantor Cabang Yogyakarta Katamso agar tidak melanggar Kode Etik Notaris. Penelitian ini bersifat deskriptif dengan menggunakan metode pendekatan empiris diarahkan pada pencarian data primer dari para narasumber dan responden melalui wawancara dengan alat pedoman wawancara. Penelitian ini dianalisis secara kualitatif, seluruh data dikumpulkan dan disusun secara sistematis oleh peneliti untuk memberi pemahaman secara komprehensif. Hasil penelitian menunjukkan bahwa, notaris telah melakukan pelanggaran Kode Etik Notaris dalam perjanjian kerjasama dengan Bank Rakyat Indonesia yaitu dengan mengajukan permohonan diri, menempatkan Bank Rakyat Indonesia sebagai perantara untuk mendapatkan klien dan honorarium serta notaris menjadi bersikap tidak mandiri dan berpihak pada salah satu pihak. Hal tersebut dilakukan notaris karena pertama, persaingan sangat ketat dalam satu kota, sehingga notaris mencari cara untuk tetap mendapatkan klien dan honorarium. Kedua, kelemahan Dewan Kehormatan Notaris Daerah yang tidak menjalankan program kerja dalam memberikan pengarahan tentang Kode Etik Notaris secara berkala. Ketiga, Dewan Kehormatan Notaris Daerah belum pernah menjatuhkan sanksi, oleh karena itu kurang menimbulkan efek jera bagi oknum notaris yang melanggar Kode Etik Notaris. Peranan Dewan Kehormatan Notaris Daerah dalam rangka pencegahan dan penegakan masih kurang berperan proaktif dan belum efektif.

This thesis aims to find out, study and analyze 1)The application to become a notary partner of BRI Bank Yogyakarta Katamso Branch Office violates the Notary Code of Ethics 2)The role of the Yogyakarta City Regional Notary Honorary Council in the context of prevention and enforcement of the Notary Code of Ethics.3)The solution to the problem is in the partnership agreement between a notary and Bank Rakyat Indonesia, Yogyakarta Katamso Branch so as not to violate the Notary Code of Ethics. This research is descriptive using an empirical approach method directed at finding primary data from resource persons and respondents through interviews with interview guidelines. The study was analyzed qualitatively, all data was collected and arranged systematically by researchers to provide a comprehensive understanding. The results showed that, the notary had violated the Notary Code of Ethics in the cooperation agreement with Bank Rakyat Indonesia by submitting a self-application, placing Bank Rakyat Indonesia as an intermediary for obtaining clients and honorarium, as well as the notary being not independent and siding with one of the parties.This was done by a notary public because first, competition was very tight in one city,so the notary is looking for a way to keep getting clients and honorarium.Second, the weakness of the Regional Notary Honorary Council which does not carry out a work program in providing periodic guidance on the Notary's Code of Ethics.Third, the Regional Notary Honorary Council has never imposed a sanction, therefore it does not have a deterrent effect on notary persons who violate the Notary Code of Ethics.The role of the Regional Notary Honorary Council in the context of prevention and enforcement is still less proactive and ineffective.
