PERLINDUNGAN HUKUM BAGI PERAWAT KONTRAK TERHADAP BEBAN KERJA DI RSUD JAILOLO, KABUPATEN HALMAHERA BARAT

Intisari Oleh: Ryan Tude Pembimbing: Prof. Dr. Ari Hernawan, S.H., M.Hum Rumah Sakit Umum Daerah Jailolo memiliki jumlah sumber daya manusia yang banyak terutama tenaga kontrak yang setiap tahun jumlahnya terus bertambah untuk mendukung dan mengimbangi pelayanan kesehatan yang terus bertambah. Terhitung dari bulan januari 2018 tenaga perawat yang bekerja di RSUD berjumlah 98 orang yang terbagi menjadi tiga jenis tenaga perawat yaitu perawat Pegawai Negeri Sipil (PNS), perawat kontrak dan tenaga kerja sukarela. Tetapi yang menjadi fokus pada penelitian ini adalah perawat dengan status kontrak yang di bekerja di RSUD Jailolo. Penelitian ini bertujuan tntuk mengetahui, memahami dan mengkaji lebih jauh mengenai pelaksanaan perlindungan hukum terkait beban kerja perawat kontrak dan untuk mengetahui, memahami dan mengkaji mengenai faktor-faktor yang menjadi hambatan pelaksanaan perlindungan hukum perawat kontrak terhadap beban kerja di Rumah Sakit Umum Daerah Jailolo kabupaten Halmahera Barat. Penelitian ini merupakan penelitian hukum empiris karena penelitian ini dilakukan dengan cara meneliti data-data primer. Jenis penelitian ini adalah penelitian analitik deskriptif dengan pendeketan observasional analitik dan depth interview. Penelitian ini berusaha mencari informasi yang aktual dan faktual tentang beban kerja perawat kontrak yang ada di RSUD Jailolo. Hasil penelitian menunjukan bahwa beban kerja perawat kontrak di Rumah Sakit Umum Daerah Jailolo masih dalam batas normal, hal ini juga sejalan kebijakan dari RSUD Jailolo yang telah berupaya semaksimal untuk memenuhi kebutuhan bagian keperawatan dengan cara merekrut pegawai kontrak dan juga dengan menyediakan tenaga kerja yang cukup baik kuantitas maupun kualitasnya sesuai dengan tuntutan kerja. Ada dua hal yang mempengaruhi kondisi beban kerja perawat kontrak yaitu faktor ekternal dan Internal. Faktor ekternal pada saat penelitian di RSUD Jailolo adalah pelimpahan tugas, bai dari dokter ke perawat maupun dari kepala ruang keperawatan kepada perawat pelaksana dalam hal ini perawat kontrak. Faktor Internal atau kondisi perawat itu sendiri maksudnya kemampuan yang tinggi dan kerja keras dari perawat dalam menjalankan tanggung jawabnya.

Abstract Jailolo Regional General Hospital has a large number of human resources, especially contract workers, whose numbers continue grow every year to support and balance the growing health services. As for January 2018, the number of nurses working in the hospital is divided into three types of nurses, namely Civil Servant nurses, contract nurses and voluntary labor. Focus of this study is a nurse with a contract status who works at Jailolo Hospital. This study aims to find out, understand and study further about the implementation of legal protection related to the workload of contract nurses and to find out, understand and study the factors that are obstacles to implementing legal protection for contract nurses on workload at the Jailolo Regional General Hospital, West Halmahera Regency. This research is an empirical legal research because this research was conducted by examining primary data. This type of research is descriptive analytic research with analytic observational approaches and depth interviews. This study seeks to find actual and factual information about the workload of contract nurses in Jailolo Hospital. The results showed that the workload of contract nurses at the Jailolo Regional General Hospital was still within normal limits, this is also in line with the policy of Jailolo Hospital which has made every effort to meet the needs of the nursing department by recruiting contract employees and also by providing a fairly good workforce. quantity and quality in accordance with the demands of work. There are two things that affect the workload condition of the contract nurse's, such as external and internal factors. The external factor at the time of research at Jailolo Hospital was the delegation of tasks, from doctors to nurses and from the head of the nursing to the executive nurse. Internal factors or the condition of the nurse itself means the high ability and hard work of the nurse in carrying out their responsibilities. Keywords: legal protection, workload, contract nurse
