Supervising and Controlling the Marine Location Permit of Outermost Small Islands through Online Single Submission: Challenges and Suggestions

Penelitian hukum ini dimaksudkan untuk melihat implikasi terhadap penerapan Perizinan Berusaha berdasarkan Peraturan Pemerintah No. 24 tahun 2018 tentang Pelayanan Perizinan Berusaha Terintegrasi Secara Elektronik, yang dimana penelitian ini bertujuan untuk meneliti implikasi pada otoritas Badan Pemerintah yang mengeluarkan Izin Lokasi Perairan dan juga untuk menganalisis tantangan dalam mengimplementasikan sistem OSS. Penelitian hukum ini dilakukan melalui penelitian hukum Normatif-Empiris, data untuk penelitian ini dikumpulkan dari studi literatur dan Penelitian Lapangan untuk mengidentifikasi implementasi Perizinan Berusaha melalui sistem OSS. Hasil Penelitian Hukum menunjukkan bahwa ada beberapa implikasi; dualitas atas otoritas penerbitan izin, penerbitan izin belum efektif, dan implikasi penerapan otorisasi diam-diam. Dengan demikian, untuk menghadapi tantangan tersebut dalam mengeluarkan izin, Badan Pemerintah harus mengeluarkan izin secara konkret dan komprehensif dan juga untuk mengurangi risiko degradasi Pulau-Pulau Kecil Terluar, Pemerintah harus mempercepat pembuatan Rencana Zonasi.

This legal research is intended to look into the implications upon the implementation of Business Licenses under Government Regulation No. 24 of 2018 regarding the Electronically Integrated Business Licenses, which aims to research the implication on the authority of Government Body that issued the Marine Location Permit and also to analyze the challenge in implementing the OSS system. This legal research is conducted through Normative-Empirical legal research, the data for the research is collected from literature studies and Field Research to identify the implementation of Business Licenses through the OSS system. The result of the Legal Research indicates that there are several implications; Duality of Authorized Body in the Issuance of Permit, Issuance of Ineffective Permit, and the implication of implementing Tacit Authorization. Therefore, to overcome the challenges in issuing the permit, the Government Bodies must issue the permit in a concrete and comprehensive manner, and to mitigate the risk of Outermost Small Island degradation the Government must accelerate the creation of Zoning Plan.
