PERANAN MAJELIS PENGAWAS DAERAH NOTARIS DAN DEWAN KEHORMATAN DAERAH NOTARIS DALAM RANGKA PENEGAKAN KODE ETIK NOTARIS DI KABUPATEN SLEMAN

Penelitian ini bertujuan untuk: 1) mengetahui dan menganalisis peranan Majelis Pengawas Daerah Notaris dan Dewan Kehormatan Daerah Notaris dalam rangka penegakan Kode Etik Notaris di Kabupaten Sleman. 2) mengetahui dan menganalisis bentuk kerjasama antara Majelis Pengawas Daerah Notaris dan Dewan Kehormatan Daerah Notaris dalam rangka penjatuhan sanksi jika terjadi pelanggaran Kode Etik Notarisdi Kabupaten Sleman. Penelitian ini merupakan suatu penelitian empiris dan bersifat deskriptif, data primer diperoleh melalui wawancara dengan alat pedoman wawancara. Penentuan sampel berdasarkan purposive sampling dengan teknik pengambilan sampel yang digunakan adalah non-probability sampling. Penelitian ini dianalisis secara kualitatif dengan metode berfikir induktif, seluruh data disusun secara sistematis untuk memberi pemahaman secara komprehensif. Hasil penelitian ini Majelis Pengawas Daerah Notaris dan Dewan Kehormatan Daerah Notaris dalam rangka penegakan Kode Etik Notaris di Kabupaten Sleman masih kurang berperan efektif. Pengawasan dan pembinaan yang dilakukan belum dapat dilaksanakan secara maksimal, karena Majelis Pengawas Daerah Notaris hanya melakukan pengawasan satu kali dalam setahun sehingga tidak semua Notaris di Kabupaten Sleman diperiksa secara keseluruhan. Dewan Kehormatan Daerah Notaris melakukan pengawasan secara insidental, sehingga pengawasan yang dilakukan belum terjadwal secara rutin. Pembinaan yang dilakukan belum efektif karena kedua badan tersebut belum dapat melakukan pembinaan secara berkesinambungan terhadap sanksi yang diberikan kepada Notaris yang melanggar Kode Etik Notaris, belum ada pemberian sanksi yang lebih tegas kepada Notaris yang melanggar Kode Etik Notaris secara berulang-ulang atau Notaris yang tidak melakukan perbaikan setelah diberikan sanksi. Kerjasama antara Majelis Pengawas Daerah Notaris dan Dewan Kehormatan Daerah Notaris bersifat koordinasi dan kerjasama, yaitu koordinasi dan kerjasama pembimbingan, koordinasi dan kerjasama pengawasan, dan koordinasi dan kerjasama pembinaan.

This study aims to: 1) find out and analyze the role of the Notary Regional Supervisory Council and the Notary Regional Honorary Council in enforcing the Notary Code of Ethics in Sleman. 2) find out and analyze the form of cooperation between the Notary Regional Supervisory Council and the Notary Regional Honorary Council in the context of imposing sanctions in the event of a violation of the Notary Code of Ethics in Sleman. This research is an empirical and descriptive study, primary data are obtained through interview with interview guidelines. Determination of the sample is based on purposive sampling with the sampling technique that is used is non-probability sampling. This study is analyzed qualitatively by using method of inductive thinking, all data are arranged systematically to provide a comprehensive understanding. The result of this study is the Notary Regional Supervisory Council and the Notary Regional Honorary Council in enforcing the Notary Code of Ethics in Sleman which is still lack of effective role. Supervision and guidance can not be carried out optimally, because the Notary Regional Supervisory Council only supervises once a year so not all Notaries in Sleman are examined as a whole. The Notary Regional Honorary Council supervises incidentally, so supervision is not regularly scheduled. Guidance has not been effective because the two councils have not been able to provide ongoing guidance for sanctions that are imposed on Notaries who violate the Notary Code of Ethics, there has been no more strict sanctions that are given to Notaries who violate the Notary Code of Ethics repeatedly or Notaries who do not improve after being sanctioned. The cooperation between the Notary Regional Supervisory Council and the Notary Regional Honorary Council is coordination and cooperation, which are the coordination and cooperation of guidance, coordination and cooperation of supervision, and coordination and cooperation of development.
