INTISARI Tujuan penelitian ini yaitu untuk mengetahui dan menganalisis proses pemeriksaan yang dilakukan oleh Majelis Kehormatan Notaris dalam memberikan persetujuan kepada penyidik terkait pemanggilan notaris di Kabupaten Kotawaringin Timur, Pertimbangan yang dipakai oleh Majelis Kehormatan Notaris dalam memberikan persetujuan kepada penyidik terkait pemanggilan notaris di Kabupaten Kotawaringin Timur serta bentuk pendampingan yang dilakukan oleh Majelis Kehormatan Notaris dalam hal notaris mendapat pemanggilan dari penyidik di Kabupaten Kotawaringin Timur. Jenis penelitian yang digunakan bersifat empiris. Cara memperoleh data dengan penelitian kepustakaan guna memperoleh data sekunder dan penelitian lapangan guna memperoleh data primer yang dilakukan dengan wawancara terhadap narasumber dan responden. Notaris yang diduga melakukan tindak pidana sehingga mendapat surat pemanggilan dari aparat hukum (penyidik, penuntut umum dan hakim), maka berkaitan dengan tugasnya MKNW sesuai dengan wilayah kerja Notaris yang bersangkutan, akan melakukan suatu proses untuk membuat keputusan dengan cara pembentukan Majelis Pemeriksa oleh Ketua MKNW untuk mendengarkan keterangan notaris yang bersangkutan. Majelis Pemeriksa berwenang untuk membuat keputusan yaitu apakah memberikan persetujuan atau penolakan terhadap permintaan persetujuan pemanggilan Notaris untuk hadir dalam penyidikan, penuntutan dan proses peradilan. Notaris yang diduga melakukan tindak pidana jika secara ikhlas dan sukarela ingin langsung memenuhi panggilan dari penyidik maka hal tersebut diperbolehkan, misalnya ingin memberikan penjelasan yang menyeluruh kepada pihak yang memanggil atau karena Notaris tersebut ingin menggunakan kewajiban ingkar yang dimiliknya. Notaris yang memutuskan untuk melakukan hal tersebut maka segala sesuatunya beserta konsekuensi hukum yang ditimbulkan akan menjadi tanggung jawab Notaris yang bersangkutan.

The purpose of this research was to find out and analyze the examination process carried out by the Notary Honorary Council in giving consent to investigators related to the notary summons in East Kotawaringin District, the considerations used by the Notary Honorary Council in giving approval to investigators related to the summon of notary in East Kotawaringin Regency and the form of assistance provided by the Notary Honorary Council in the case of a notary received a summons from the investigator in East Kotawaringin Regency. The type of research in this study is empiric. The data have been collected from library research to get secondary data and field research to get primary data conducted by interviewing resource persons and respondents. The notary who is suspected of committing a criminal offense so that he gets a summons from the legal apparatus (investigators, public prosecutors and judges), then in connection with the task of Notary Honorary Council Regional in accordance with the working area of the Notary concerned, will carry out a process to make a decision by establishing the Examining Panel by the Chairman of the Notary Honorary Council Regional to hear the statement from a notary concerned. The Examining Panel has the authority to make a decision on whether to approve or reject the request for approval of the Notary Public to be present in the investigation, prosecution and judicial process. the notary who is suspected of committing a criminal offense if sincerely and voluntarily wishes to directly fulfill the summons from the investigator then that is permissible, for example, wanting to provide a comprehensive explanation to the party calling or because the Notary wants to use his or her denial obligations. The notary decides to do this, so that everything along with the legal consequences that arise will be the responsibility of the concerned Notary.
