Implementasi Kewenangan Majelis Pengawas Daerah Dalam Melakukan Pemeriksaan Rutin Terhadap Protokol Notaris Di Kabupaten Sleman

Penelitian Hukum ini bertujuan untuk mengetahui dan menganalisis faktor penghambat yang dihadapi oleh Majelis Pengawas Daerah Kabupaten Sleman dalam hal melakukan pemeriksaan terhadap Protokol Notaris sebagaimana yang telah diamanatkan oleh Pasal 70 huruf (b) Undang-Undang Jabatan Notaris serta upaya yang dilakukan oleh Majelis Pengawas Daerah Kabupaten Sleman dalam rangka optimalisasi kinerja mengenai pemeriksaan Protokol Notaris sebagaimana yang telah diamanatkan oleh Undang-Undang Jabatan Notaris. Jenis penelitian ini adalah normatif-empiris dengan data primer yang dilakukan dengan wawancara kepada subjek penelitian menggunakan pedoman wawancara dan data sekunder yang mengacu pada bahan hukum terkait permasalahan. Penelitian ini bersifat deskriptif dan dianalisis menggunakan metode kualitatif. Hasil Penelitian Hukum ini menunjukan implementasi kewenangan MPD Sleman belum sepenuhnya sesuai dengan ketentuan yang diatur dalam Pasal 70 huruf (b) UUJN dikarenakan faktor internal MPD Sleman yang sulit untuk membagi dan menyocokan waktu pemeriksaan antar anggota MPD karena kesibukan tugas dan profesi masing-masing unsur, faktor kesiapan dari Notaris yang diperiksa dan jumlah formasi Notaris Sleman yang berjumlah 197 orang tidak sebanding dengan jumlah MPD yang hanya 9 orang serta faktor anggaran dana yang berimplikasi pada jatah pemeriksaan Protokol Notaris. Langkah optimalisasi yang dapat dilakukan oleh MPD Sleman ialah dengan koordinasi antar MPD agar pemeriksaaan Protokol Notaris dapat dilakukan sejak awal tahun sehingga pada akhir tahun seluruh formasi Notaris yang menjadi target pemeriksa dapat tercapai. INI seharusnya lebih aktif memberikan pengarahan kepada calon Notaris maupun Notaris mengenai segala sesuatu yang berkaitan dengan dunia Kenotariatan khususnya dalam hal ini mengenai pemeriksaan Protokol Notaris agar nantinya dapat mempermudah MPD yang melakukan pemeriksaan guna efektivitas dan efisiensi waktu pemeriksaan. Pemerintah seharusnya menambah anggaran dana pemeriksaan Protokol Notaris yang berimbas pada penambahan jatah pemeriksaan sehingga target pemeriksaan Protokol Notaris terhadap keseluruhan formasi Notaris dalam kurun waktu 1 kali dalam 1 tahun dapat terpenuhi.

This Legal Research aims to study and analyze the obstacle factors encounterred by the Regional Supervisory Board of Sleman Regency when conducting inspection on the Notary Protocol mandated by Article 70 letter (b) of the Notary Law as well as the means made by the Regional Supervisor Board of Sleman Regency in order to optimize the results of the Inspection of the Notary Protocol that has been mandated by the Law of Notary Position. The legal research employed normative-empiric approach with primary data by conducting by interviews to the research subjects, utilizing the interview guidelines and secondary data based on legal material related to the problem. This research is descriptive in nature and analyzed using qualitative methods. The results of this Legal Research show that the implementation of the authority of the Sleman�s MPD has not been fully in accordance with the provisions stipulated in Article 70 letter (b) of the UUJN due to the internal factors of the Sleman�s MPD, which are the difficulty in dividinge and matching the schedule of inspection between MPD members due to the activity of working and profession of each element, the readiness factor of the examined Notary and the total of Sleman Notary which amount to 197 people is not proportional to the number of MPD which is only 9 members and the factor of fund availability which has implications for the remuneration for the Notary Protocol inspection quota. The optimization means which can be conducted by the Sleman�s MPD is coordinatinge between MPD so that the Notary protocol inspection can be conducted since the beginning of the year so that at the end of the year all of the targetted Notary can be achieved. INI should be more active in giving direction to prospective Notary and Notary regarding everything related to the Notary, especially in this case regarding the inspection of the Notary Protocol in order to ease the MPD who conducts the inspection for the effectiveness and efficiency of the inspection time. The government should also increase the budget for the inspection of the Notary Protocol, which affects the increasing of the remuneration for the inspection of all Notary so that the target of the Notary Protocol Inspection of all Notary within 1 period 1 year can be fulfilled.
