Upaya Penanggulangan Pelecehan Terhadap Perempuan di Ranah Publik di Provinsi Daerah Istimewa Yogyakarta

UPAYA PENANGGULANGAN PELECEHAN SEKSUAL TERHADAP PEREMPUAN DI RANAH PUBLIK DI PROVINSI DAERAH ISTIMEWA YOGYAKARTA Penelitian hukum ini bertujuan untuk mengetahui dan mengkaji faktor-faktor penyebab terjadinya pelecehan seksual terhadap perempuan di Provinsi Daerah Istimewa Yogyakarta. Selain tujuan tersebut, penelitian hukum ini juga bertujuan untuk mengetahui dan mengkaji penanggulangan yang dilakukan oleh pihak-pihak terkait seperti, kepolisian, kejaksaan, Unit Pelaksana Teknis Daerah Perlindungan Perempuan dan Anak, dan Dinas Pemberdayaan Perempuan dan Anak dalam mengatasi masalah tersebut. Penelitian ini bersifat deskriptif dengan jenis normatif empiris. Penelitian normatif dilakukan melalui penelitian kepustakaan atas berbagai bahan hukum, baik bahan hukum primer, sekunder, dan tersier, untuk mendapatkan data sekunder dilakukan melalui studi dokumen. Penelitian empiris dilakukan untuk mendapatkan data primer melalui penelitian lapangan dengan cara wawancara dengan subjek penelitian berupa responden dan narasumber dengan mempergunakan pedoman wawancara. Data yang diperoleh dari hasil penelitian kepustakaan dan lapangan dianalisis secara kualitatif. Hasil analisis data disajikan secara deskriptif analitis. Hasil penelitian menunjukkan: 1) faktor penyebab terjadinya pelecehan seksual terhadap perempuan di ranah publik di Provinsi Daerah Istimewa Yogyakarta antara lain, diskriminasi konstruksi gender, kurangnya kesadaran masyarakat, kekosongan hukum, lemahnya kontrol dari kelompok sosial, infrastruktur yang kurang memadai, reviktimisasi terhadap korban. 2) Upaya penanggulangan pelecehan seksual terhadap perempuan di ranah publik di Provinsi Daerah Istimewa Yogyakarta, terdapat upaya penal antara lain penyidikan, penuntutan, pelaksanaan putusan hakim, pelayanan dalam bentuk pengaduan dan pendampingan terhadap korban. Untuk upaya non penal antara lain pembentukan Forum Perlindungan Korban Kekerasan, sosialisasi mengenai hak-hak perempuan, patroli oleh kepolisian, program Jaksa Masuk Sekolah dan Jaksa Menyapa oleh Kejaksaan.

PENAL AND NON PENAL ACTIONS OF SEXUAL HARASSMENT AGAINTS WOMEN IN PUBLIC SPACES IN SPECIAL PROVINCE OF YOGYAKARTA This legal research aims to determine and examine the factors that cause sexual harassment against women in the public spaces in the Special Province of Yogyakarta. In addition to these objectives, this legal research also aims to find out and assess countermeasures carried out by related parties such as the police, prosecutors, the Regional Technical Implementation Unit for the Protection of Women and Children, and the Office of Women's and Children Empowerment in overcoming these problems. This research is descriptive with an empirical normative type. Normative research is conducted through by library research on various legal materials, both primary, secondary and tertiary legal materials, to obtain secondary data through document studies. Empirical research was conducted to obtain primary data through field research by interviewing research subject in the form of respondents and resource persons by using interview guidelines. Data obtainend from the result of library and field research are analyzed qualitatively. The result of data analysis are presented descriptively analytically. The result showed: 1) the causes of sexual harassment against women in the public spaces in the Special Province of Yogyakarta, among others, discrimination on gender construction, lack of public awareness, legal vacuum, weak control from social groups, inadequate infrastructure, re-victimization of victims. 2) efforts to tackle sexual harassment against women in public spaces in the Special Province of Yogyakarta, there are penal efforts including investigations, prosecutions, implementation of judge decisions, services in the form of complaints and assistance to victims. For non-penal efforts, among others, the formation of the Forum for Victims of Violance Protection, dissemination of information on women's rights, patrols by the police, the Prosecutors Enter School Program and the Prosecutor Greets by the Prosecutors.
