Upaya Perlindungan Hak Pilih bagi Pemilih yang Tidak Berada di Tempat pada saat Hari Pemungutan Suara

Penelitian ini berfokus pada upaya penjaminan hak pilih warga Negara terutama pemilih yang tidak berada di tempat pada hari pemungutan suara dimana mereka berpotensi kehilangan hak pilihnya dalam sistem pemilu yang ada sekarang. Secara empiris pemilu yang aksesibilitas ternyata belum tercapai dan secara normatif belum ada regulasi yang mengatur secara detail mekanisme pemungutan suara terutama bagi pemilih yang tidak berada di tempat pada hari pemungutan suara. Landasan teori dalam penelitian ini menggunakan konteks hak asasi manusia dimana hak pilih merupakan bagian dari hak politik suatu individu yang dijamin oleh konstitusi yang pemenuhannya harus dijamin oleh Negara. Dalam Pemilu yang demokratis harus memiliki prinsip universal suffrage dan one person one vote one value (opovov). Universal suffrage menegaskan bahwa setiap warga Negara memiliki hak untuk berpartisipasi dalam Pemilu. Prinsip ini menuntut adanya perlakuan yang sama terhadap pemilih tanpa diskriminasi. Pemilih memiliki akses yang sama dalam proses pemungutan suara. Prinsip opovov atau kesetaraan menegaskan bahwa setiap pemilih memiliki nilai yang sama. Jenis penelitian ini adalah penelitian kepustakaan dengan lokasi penelitian di Kabupaten Cilacap. Penelitian ini menjabarkan beberapa permasalahan dalam penjaminan hak pilih bagi pemilih yang tidak berada di tempat pada hari pemungutan suara. Dan menjabarkan mekanisme pemungutan suara yang dapat digunakan untuk memberikan jaminan hak pilih yaitu: pemungutan suara secara langsung, pemungutan suara melalui pos, pemungutan suara melalui perantara dan pemungutan suara dengan menggunakan sarana elektronik. Dimana masing-masing mekanisme tersebut memiliki kelebihan dan kekurangan. Selain itu penelitian ini juga menjabarkan tentang peluang diterapkannya mekanisme tersebut pada Pilkada. Penelitian ini memberikan rekomendasi kepada penyelenggara Pemilu bahwa untuk dapat menjamin hak pilih setiap warga Negara diperlukan adanya pengaturan khusus dalam mekanisme pemungutan suara. Untuk itu diperlukan regulasi khusus dan fleksibel dengan fasilitas memudahkan pemilih untuk menggunakan hak pilihnya. Fasilitas yang memberikan kemudahan dan kenyamanan bagi pemilih seperti dengan absentee voting dengan mekanisme pemungutan suara melalui pos (mail voting).

This research focuses on the efforts to guarantee the suffrage of citizen, especially for voters who are not present on polling day where they have the potential to lose their voting rights in the current electoral system. Empirically, the elections with accessibility have not been achieved and normatively there are no regulations that govern in detail voting mechanism, especially for voters who are not present in the voting day. The theoretical basis in this study uses the human rights context where the right to vote is the part of individual's political rights that are guaranteed by the constitution whose fulfillment must be guaranteed by the State. In Democratic election, the principle of universal suffrage and one person one vote value (opovov) must be guaranteed. Universal suffrage emphasize that every citizens has the rights to participate in the election. This principle demands equal treatment of voters without discrimination, meaning that voters have the same access in the voting processand have the same value. This type of research is a research based on literature review with the research location in Cilacap regency, Central Java. This research describes several problems in securing voting rights for voters who are not present on polling day and describes the voting mechanism that can be used to provide guarantees of voting rights such as, direct voting, postal voting, voting through intermediaries and voting using electronic means, where each of these mechanism has advantages in addition. This study also describes the opportunities for mechanism to be applied to the elections. This research provides arecommendation to the organizers of general election, in order to guarantee that to guarantee the every citizens voting rights, a special arrangement is needed in the voting mechanism. Thus, special and flexible regulation is needed for voters to use their voting rights easily.Facilities that provide convenience and comfort for the voters such as the absentee voting with the voting mechanism through the mail or mail voting.
