KAJIAN TERHADAP PENGESAHAN AKTA NOTARIS YANG DILAKUKAN DI LUAR KANTOR NOTARIS Oleh : Grizelda Rahmadinna , Harry Purwanto . INTISARI Penelitian ini bertujuan untuk mengetahui dan menganalisis implementasi Pasal 3 angka 15 Kode Etik Notaris Hasil Kongres Luar Biasa INI Tahun 2015 terhadap Notaris yang melakukan pengesahan akta di luar kantor Notaris, kedudukan akta dan tanggungjawab Notaris terhadap akta yang pengesahannya dilakukan di luar kantor Notaris ditinjau dari UUJN dan Kode Etik Notaris. Jenis penelitian ini adalah normatif-empiris dengan data primer yang dilakukan dengan wawancara kepada subjek penelitian menggunakan pedoman wawancara dan data sekunder yang mengacu pada bahan hukum terkait permasalahan. Penelitian ini bersifat deskriptif dan dianalisis menggunakan metode kualitatif. Hasil penelitian ini menunjukkan bahwa implementasi Pasal 3 angka 15 Kode Etik Notaris di Kota Yogyakarta, masih terdapat Notaris yang melakukan pengesahan akta di luar Kantor, dikarenakan belum ada peraturan lebih lanjut mengenai batasan alasan keadaan mendesak seorang Notaris melakukan pengesahan akta di luar kantor. Pengesahan Akta Notaris yang dilakukan di luar kantor ditinjau dari UUJN/P dan Kode Etik Notaris, apabila yang dilanggar adalah UUJN/P maka akta tersebut dapat terdegradasi menjadi akta di bawah tangan atau batal demi hukum, namun apabila pelanggaran terhadap Kode Etik Notaris maka akta tersebut tetap tidak ada perubahan status akta yakni tetap autentik. Tanggung jawab Notaris terhadap pengesahan akta yang dilakukan di luar kantor, apabila timbul kerugian bagi para pihak, maka Notaris bertanggungjawab secara administrasi maupun perdata. STUDY ON VALIDATION OF NOTARIAL DOCUMENT TAKEN OUTSIDE THE NOTARY OFFICE By: Grizelda Rahmadinna, Harry Purwanto. ABSTRACT This study aims to determine and analyze the implementation of Article 3 number 15 of notary ethical code from the Extraordinary Congress of the Year 2015 for Notaries who ratify the deeds outside the Notary Office, the position of the deed and the responsibility of the Notary towards deed whose ratification is conducted outside the Notary Office in terms of UUJN and Notary Ethical Code. This type of research is normative-empiric with primary data which is conducted by interviews with research subjects using interview guidelines and secondary data that refers to legal material related to the problem. This research is descriptive and analyzed using qualitative methods. The results of this study shows the implementation of Article 3 number 15 of the Notary Ethical Code in the City of Yogyakarta, there are still Notaries who ratify the deeds outside the Office, because there are no further regulation regarding the reasons for the urgency of a Notary to ratify the deeds outside the office. Ratification of the Notary Deed that is conducted, if the violation is UUJN / P and Notary Ethical Code, then the deed may be degraded to underhanded deed or null and void by law, but if a violation of the Notary Ethical Code, then there is no change in the status of the deed, which is still authentic.The Notary's responsibility for the ratification of the deed is conducted outside the office, if causing losses to the parties, the Notary may be responsible both administratively and civilly.
