TINDAK LANJUT PENGATURAN SUMBER DAYA AIR PASCA PUTUSAN MAHKAMAH KONSTITUSI NOMOR 85/PUU-XI/2013 TERHADAP HAK ATAS AIR DI INDONESIA

Penelitian ini bertujuan untuk mengetahui dan menganalisis tindak lanjut pengaturan sumber daya air pasca Putusan Mahkamah Konstitusi Nomor 85/PUU-XI/2013 dan dampaknya terhadap penghormatan, perlindungan, dan pemenuhan hak atas air di Indonesia. Jenis penelitian yang digunakan adalah penelitian normatif dengan pendekatan kualitatif. Hasil penelitian kemudian dianalisis dengan pendekatan sistematis guna menjawab permasalahan pada penelitian ini. Hasil penelitian ini menunjukkan bahwa Putusan Nomor 85/PUU-XI/2013 sebagai putusan yang memiliki beberapa peraturan perundang-undangan sebagai tindak lanjutnya diantaranya PP No. 121 Tahun 2015 tentang Pengusahaan Sumber Daya Air, PP No. 122 Tahun 2015 tentang Sistem Penyediaan Air Minum, Perpres No. 90 Tahun 2016 tentang Badan Peningkatan Penyelenggaraan Sistem Penyediaan Air Minum, dan UU No. 17 Tahun 2019 tentang Sumber Daya Air. Hasil penelusuran terhadap berbagai peraturan tersebut menunjukkan bahwa penghormatan, perlindungan, dan pemenuhan hak atas air belum sepenuhnya terwujud.

This study aims to identify and analyse the follow up to the water resources regulation after the Constitutional Court Decision No. 85/PUU-XI/2013 and its impact to respect, protection, and fulfilment of the right to water. The type of research in this study is a normative research with qualitative approach using systematic analysed to answer the questions research. The result of this study indicate that the Constitutional Court Decision Number 85/PUU-XI/2013 has several regulations as a follow up including Government Regulation No. 121 of 2015, Government Regulation No. 122 of 2015, Presidential Regulation No. 90 of 2016, and Water Resources Law No. 17 of 2019. The result of this research indicate that state������¢���¯���¿���½���¯���¿���½s obligation to respect, to protect, and to fulfil the right to water has not yet been fully realized.
