Tinjauan Yuridis Perlindungan Hutan oleh Pemegang Izin di Kawasan Hutan Produksi

Hutan merupakan anugerah Tuhan Yang Mah Esa yang harus disyukuri keberdaannya karena telah memberikan banyak manfaat baik dari segi ekonomi sosial budaya, maupun ekologi. Dalam rangka pembangunan ekonomi nasional maka Pemerintah Indonesia menerbitkan beberapa peraturan yang menjadi landasan legal bagi praktek pemanfaatan hutan di Indonesia. Kegiatan pemanfaatan hutan dapat dapat dilakukan pada kawasan hutan produksi yang wajib menggunakan Izin Pemanfaatan Hutan. Pemanfaatan hutan telah memberikan banyak dampak positif kepada bangsa Indonesia namun di sisi lain keberadaan hutan juga dapat menimbulkan dampak negatif terhadap lingkungan hidup apabila pemanfaatannya tidak dikelola secara bijak. Realitas yang ada menunjukkan bahwa kerusakan hutan di Indonesia semakin parah. Jenis penelitian hukum yang penulis gunakan adalah penulisan hukum normatif dengan teknik pengumpulan data studi dokumen atau penelitian kepustakaan. Rumusan masalah penelitian ini adalah (1) Bagaimanakah peraturan perundangan mengatur kewajiban pemegang izin pemanfaatan hutan produksi dalam perlindungan hutan? (2) Apa saja masalah yang dihadapi berkaitan dengan pengaturan yang mengatur kewajiban pemegang izin pemanfaatan hutan produksi dalam perlindungan hutan produksi? Hasil penelitian Penulis menunjukan bahwa pengaturan di bidang kehutanan telah terdapat berbagai peraturan yang memberikan kewajiban kepada pemegang izin pemanfaatan hutan produksi yang berkaitan dengan perlindungan hutan. Namun masih ada beberapa masalah pada segi struktur hukum, substansi hukum dan budaya hukum sehingga perlindungan hutan di Indonesia belum berjalan dengan baik dan masih banyak kerusakan hutan di Indonesia

The forest is a gift from God Almighty who should be grateful for its existence because it has provided many benefits both in terms of socio-cultural, economic and ecological aspects. In the context of national economic development, the Government of Indonesia issued several regulations which became the legal basis for the practice of forest use in Indonesia. Forest utilization activities can be carried out in production forest areas that are required to use a Forest Utilization Permit. Forest utilization has had many positive impacts on the Indonesian people but on the other hand the existence of forests can also have negative impacts on the environment if their utilization is not managed wisely. The reality shows that forest destruction in Indonesia is getting worse. The type of legal research that the author uses is normative legal writing with document study data collection techniques or library research. The formulation of the problem of this research are (1) How does the regulation regulate the obligations of the holder of production forest utilization permit in forest protection? (2) What are the problems faced in relation to the regulation governing the obligations of the holder of production forest utilization permit in the protection of production forest? The author's research results show that in the forestry sector there have been various regulations that give obligations to holders of production forest utilization permits relating to forest protection. But there are still some problems in terms of legal structure, legal substance and legal culture so that forest protection in Indonesia has not gone well and there is still a lot of forest damage in Indonesia
