Legal Analysis of Case of the Stolen Children of Timor-Leste: Indonesia's Compatibility with International Law on the Right to Nationality

Dalam rentang tahun 1975 s.d. 1999, banyak anak anak yang hilang dikarenakan parahnya konflik di timor leste. Disamping itu, metode penempatan yang kurang baik menyebabkan anak anak tersebut kehilangan akses yang layak untuk identifikasi, registrasi, dokumentasi, pencarian keluarga, sistem pengasuhan terpadu atau bantuan hukum. Ketidakadaan dokumentasi merupakan masalah yang dihadapi oleh orang orang ini, hal ini pun menciptakan masalah lebih jauh termasuk masalah dalam mengakses fasilitas/layanan publik, yang mana menyebabkan mereka kehilangan hak hak mereka. Hal ini menyebabkan meningkatnya perhatian dari komunitas international mengenai perlindungan HAM untuk korban konflik serta penyediaan rehabilitasi dan ganti rugi untuk korban dan anggota keluarga korban. Beberapa resolusi dan rekomendasi telah dikeluarkan dari badan badan PBB serta komisi komisi yang ada, hal tersebut diperhatikan oleh pemerintah indonesia yang kemudian mengeluarkan Keputusan Presiden no. 72/2011 sebagai usaha pemenuhan resolusi resolusi dan rekomendasi tersebut. Melalui penulisan hukum ini, cakupan dari kewajiban indonesia dalam melindungi dan memenuhi HAM anak anak yang terpisah dari timor leste akan dibahas lebih jauh.

In the period between the years of 1975 to 1999, several thousands of children were unaccounted for due to the conflict in Timor Leste. Due to the method of transfer, a majority of these unaccompanied children had no access to proper and appropriate identification, registration, documentation, family tracing, guardianship systems or legal advice. Absence of documentation was a problem faced by these individuals, as it creates difficulties in gaining access to public facilities and services, causing them to be deprived of a number of rights entailed. This has resulted in the rise of attention by the international community in the protection of the human rights of the victims as well as in providing rehabilitation and reparation for both victims and their family members. A number of resolutions and recommendations were issued by United Nations organs as well as established commissions, these were taken into account by the Indonesian government where its effort in the fulfillment were shown through the issuance of Presidential Decree no. 72 of 2011. Through this legal research, the extent of Indonesia�s obligation is addressed in protecting and fulfilling the human rights of separated children of Timor Leste residing in its territory.
