INTISARI Banyaknya peraturan perundang-undangan di Indonesia saat ini belum mencapai kualitas yang diharapkan. Hal ini tampak dari permasalahan over regulation yang disebabkan oleh peraturan yang tidak harmonis dan tumpang tindih, serta penilaian indeks kualitas regulasi dari World Bank yang masih berada di peringkat rendah dibanding negara berkembang lainnya. Salah satu produk peraturan yang menyumbang masalah over regulation terbanyak adalah peraturan menteri/pimpinan lembaga dikarenakan Peraturan Menteri tidak berada dalam hierarki peraturan perundang-undangan, namun hanya dibentuk berdasarkan perintah peraturan yang lebih tinggi atau berdasarkan kewenangan yang dimiliki. Untuk mengatasi hal tersebut, Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional menyusun Peraturan Menteri ATR/KBPN Nomor 21 Tahun 2016 tentang Pembentukan dan Evaluasi Produk Hukum di Lingkungan Kementerian ATR/BPN dalam upaya penataan peraturan perundang-undangan. Namun demikian, setelah kurang lebih 3 (tiga) tahun berjalan, penilaian Reformasi Birokrasi Penataan Peraturan Perundang-undangan masih belum optimal. Sehubungan dengan permasalahan diatas, peneliti tertarik untuk mengkaji Implementasi Permen ATR/KBPN Nomor 21 Tahun 2016. Penelitian ini bertujuan mendeskripsikan implementasi dan faktor-faktor yang mempengaruhi implementasi Permen ATR/KBPN Nomor 21 Tahun 2016 tentang Pembentukan dan Penyusunan Produk Hukum di Lingkungan Kementerian ATR/BPN. Metode penelitian yang digunakan adalah deskriptif kualitatif dengan teknik pengumpulan data melalui wawancara, observasi, dan dokumentasi serta penentuan informan secara purposive. Hasil penelitian menunjukkan bahwa secara proses implementasi sudah berhasil dilakukan, akan tetapi secara hasil belum dapat menjawab semua output yang hendak dicapai. Adapun faktor-faktor yang mempengaruhi adalah isi kebijakan dan konteks implementasi.

The number of laws and regulations in Indonesia at this time has not reached the expected quality. It seems from the problem of over regulation caused by regulations that are not harmonious and overlapping, as well as an assessment of the quality index of regulations from the World Bank that stated Indonesia is still ranked low compared to other developing countries. One of the regulations that contributes to the problem of over regulation is the ministerial / institutional leader regulation, because the Ministerial Regulation is not in the hierarchy of statutory regulations, but is only formed based on higher regulation orders or based on the authority possessed. To overcome this, the Ministry of Agrarian Affairs and Spatial Planning / National Land Agency compiled Ministerial Regulation ATR / KBPN Number 21 of Year 2016 concerning Formation and Evaluation of Legal Products in the Ministry of ATR / BPN Environment in an effort to arrange laws and regulations. However, after approximately 3 (three) current years, the assessment of the Reform of the Regulatory Bureaucracy is still not optimal. Based on the above problems, researchers are interested in studying the implementation of ATR / KBPN Ministerial Regulation Number 21 of Year 2016. This study aims to describe the implementation and the factors that influence the implementation of Ministerial Regulation ATR / KBPN Number 21 of 2016 concerning Formation and Compilation of Legal Products in the Environment of Ministry of ATR / BPN. The research method is descriptive qualitative with the data collection techniques through interviews, observation, and documentation and the informants determination purposively. The results show that the implementation process has been successfully carried out, but the results have not achieved yet. Besides, the influencing factors are the content of the policy and the context of implementation.
