KAJIAN YURIDIS PEMENUHAN HAK ATAS AIR BERSIH UNTUK WARGA DI DESA PANGKAH KULON KABUPATEN GRESIK OLEH NEGARA MELALUI PAMSIMAS

Tujuan daripada dilaksankannya penelitian ini adalah untuk mengetahui dan menganalisis masalah-masalah dalam pelaksanaan pemenuhan hak terhadap akses air bersih oleh pemerintah, khususnya dalam program PAMSIMAS, terhadap warga desa Pangkah Kulon dan bagaimana solusi daripada permasalahan tersebut. Penelitian ini berjenis yuridis-empiris dan bersifat deskriptif yaitu pemaparan dengan tujuan untuk memperoleh gambaran lengkap tentang gejala yuridis yang ada. Jenis data yang diambil terdiri dari data primer dan sekunder. Data primer dalam penelitian ini berasal dari wawancara langsung dengan responden sementara data sekunder diperoleh dari bahan hukum primer, sekunder, dan tersier. Penelitian mengambil lokasi di Desa Pangkah Kulon, Ujungpangkah, Gresik. Hasil penelitian menunjukkan bahwa kualitas air masih belum memenuhi standar Peraturan Menteri Kesehatan RI No. 32 Tahun 2017 dan belum semua warga yang membutuhkan air bersih mendapatkan akses air bersih dari keberadaan program PAMSIMAS tersebut.

The purpose of this research is to find out and analyze the problems in the implementation of the fulfillment of the right to access clean water by the government, especially in the PAMSIMAS program, for the citizens of Pangkah Kulon village and how to solve these problems. This research is a juridical-empirical type and is descriptive in nature, namely exposure in order to obtain a complete picture of existing juridical symptoms. The type of data taken consists of primary and secondary data. The primary data in this study came from direct interviews with respondents while secondary data was obtained from primary, secondary and tertiary legal materials.. The study took place in the village of Pangkah Kulon, Ujungpangkah, Gresik. The results showed that the water quality still did not meet the standards of the Minister of Health's Regulation No. 32 of 2017 and not all citizens who need clean water have access to clean water from the existence of PAMSIMAS program.
