A STUDY ON EVALUATION OF HANDOVER REGULATION IMPLEMENTATION (CASE STUDY OF SPECIAL HOUSES HANDOVER, MINISTRY OF PUBLIC WORKS AND HOUSING, INDONESIA)

Sebuah terobosan dalam menjawab tantangan penyediaan perumahan di Indonesia terjadi pada tahun 2006 pada saat Kementerian Perumahan Republik Indonesia mengadakan program Rumah Khusus yang bertujuan untuk memenuhi kebutuhan khusus. Dengan terjadinya penyatuan antara Kementerian Perumahan dan Kementerian Pekerjaan Umum pada tahun 2015, program Rumah Khusus berada dalam lingkup tanggung jawab Direktorat Rumah Khusus Kementerian Pekerjaan Umum dan Perumahan Rakyat. Meskipun telah terjadi peningkatan pembangunan unit Rumah Khusus oleh direktorat baru, kenaikan persentase penyerahan aset, dan eskalasi tingkat hunian, faktor-faktor yang bertanggung jawab atas keberhasilan ini masih belum diketahui. Penelitian ini bertujuan untuk mengidentifikasi peningkatan jumlah serah terima Rumah Khusus sebagai akibat reformasi terhadap peraturan yang berlaku. Studi ini menjawab pertanyaan tentang bagaimana reformasi memperbaiki peraturan dasar penyediaan Rumah Khusus, peningkatan serah terima, dan peningkatan penghunian Rumah Khusus dengan membandingkan peraturan antara dua kementerian. Selain itu, wawancara juga mengungkapkan bahwa secara umum, perubahan peraturan menyebabkan perbaikan dalam tata kelola Rumah Khusus. Regulasi yang berlaku secara retroaktif ditemukan sebagai hasil lain dari reformasi regulasi. Meskipun ada pendapat bahwa peraturan retroaktif tidak akan mampu menyelesaikan masalah Rumah Khusus yang lama dikarenakan kompleksitas masalah yang harus diatasi oleh peraturan baru. Kemungkinan penggunaan peraturan baru secara surut disepakati oleh sebagian besar pejabat pemerintah dan merujuk pada kemajuan setelah dilakukannya penerapan peraturan secara retroaktif. Selain itu, wawancara semi-struuktur juga dilakukan kepada para pelaku utama Rumah Khusus untuk menggambarkan pengaruh perubahan organisasi terhadap koordinasi antara pemerintah pusat dan daerah. Pembentukan SNVT sebagai pemecah masalah koordinasi dapat dilihat dari dua pencapaian utama proses serah terima dan hunian. Perubahan dalam persentase tingkat serah terima dan hunian merupakan bukti kontribusi yang dilakukan oleh SNVT. Namun, pendekatan yang diambil oleh SNVT terhadap pemerintah daerah masih dianggap kurang dan perlu ditingkatkan.

An influential breakthrough in Indonesia to answer the challenge of housing provision was in 2006 when the Ministry of Housing held Special Houses program that built housing units for special purposes. Through time, Special Houses program was carried out by the Directorate of Special Houses when the unification between the Ministry of Housing and the Ministry of Public Works occurred in 2015. Although there has been improvement happened by the new directorate regarding the number of units, the percentage of asset handover, and the escalation on occupancy level, the factors responsible for these successes are not yet known. This study aims to identify the improvements to the handover of Special Houses by regulations reform. This study answers the question of how the reform ameliorates basic regulations on the provision of Special Houses, enhance the handover process, and advance the Special Houses occupancy process by comparing regulations between two ministries. Moreover, the interviews also revealed that in general, the changes in regulations lead to further refinements of governance. Retroactive regulation was found to have occurred as another result of regulatory reforms. Despite of an opinion believed that retroactive regulations would not be able to solve the old Special Houses problems, due to the complexity of the problems that should be overcome by the new regulations, the possibility of the use of new regulations retroactively agreed by most government officials and refer to the progress after the application of retroactive regulations. Moreover, semi-in-depth interviews were also carried out to the key actors of Special Houses to describe the influences of organizational changes toward coordination between central and local governments. The establishment of SNVTs as coordination problem solvers can be seen by the two major achievements of the handover and occupancy processes. The changes in the percentage of handover and occupancy levels constitute evidence the SNVTs contributions. However, the approach taken by SNVTs toward local governments is still considered to be poor and needs to be enhanced.
