PEMENUHAN HAK PENDIDIKAN BAGI ANAK YANG MENJALANI HUKUM PIDANA DIDALAM LEMBAGA PEMBINAAN KHUSUS ANAK

Tujuan penelitian adalah untuk mengetahui hak-hak pendidikan bagi anak yang menjalani proses hukuman di dalam Lembaga Pembinaan Khusus Anak (LPKA). Penelitian ini secara khusus mengkaji upaya-upaya pemenuhan hak pendidikan kejar Paket C dan pendidikan non formal, kendala-kendala apa saja yang dialami oleh para petugas dalam pemenuhan hak pendidikan kejar Paket C, dan pendidikan non formal diharapkan kedepannya agar guna pemenuhan hak pendidikan bagi anak dapat terpenuhi dengan baik. Hal ini tidak ada lagi anak yang tertinggal dan tidak terpenuhi hal-hal dalam pendidikan selama anak menjalani proses masa penahan didalam Lembaga Pembinaan Khusus Anak (LPKA). Jenis Penelitian ini adalah penelitian hukum normatif-empiris yang menggunakan data primer dan data sekunder. Data primer adalah data yang meliputi teknik wawancara kepada petugas Lembaga Pembinaan Khusus Anak (LPKA) dan anak yang menjalani proses hukuman pidana. Data sekunder adalah data yang diambil dari bahan-bahan hukum seperti: undang-undang dan buku-buku hukum yang berkaitan dengan penelitian tesis ini. Berdasarkan hasil penelitian, upaya-upaya yang dilakukan Lembaga Pembinaan Khusus Anak (LPKA) Klas I Kutoarjo meliputi pendidikan formal yang berupa pendidikan kejar Paket C dan pendidikan non formal. Pendidikan kejar Paket C dan pendidikan non formal yang tidak sesuai dengan Undang-undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak Pasal 85 mengenai hak pendidikan bagi anak khususnya saat anak menjalani masa pidana yang ditempatkan di dalam Lembaga Pembinaan Khusus Anak (LPKA). Kendala yang dihadapi yaitu kurangnya tenaga pengajar sehingga waktu belajar mengajar tidak terpenuhi dengan baik, minimnya buku-buku diperpustakaan terkait dengan pendukung kegiatan belajar mengajar yang disebabkan berubah-rubahnya sistem yang diberlakukan oleh Menteri Pendidikan Nasional, minimnya biaya operasional untuk perawatan pendidikan seni musik dan pembelian perlengkapan untuk kegiatan pendidikan prakarya.

This research aimed to find out the rights to education for the juveniles who were in detention at the juvenile detention centre (LPKA). Specifically, this research investigated the efforts of the fulfillment of Kejar Paket C and informal education, the barriers that were faced by the officers in fulfilling the rights to education of Kejar Paket C, and informal education were expected that the efficiency of the fulfillment of the rights to education for the juveniles could be fulfilled well in the future. As the result, there was no any juvenile who left behind and did not get the rights to education during the detention at Juvenile Detention Centre (LPKA). The types of this research were normative-empirical legal research that used primary and secondary data. Primary data included interview technique to the officers of Juvenile Detention Centre (LPKA) and the juveniles who were in detention. On the other hand, secondary data were taken from the legal materials, such as; laws and legal books regarding the research of this thesis. Based on the research results, the efforts that were made by the Juvenile Detention Centre (LPKA) of Class I Kutoarjo included formal education in the form of Kejar Paket C and informal education. Kejar Paket C and informal education that were inappropriate with Law Number 11 of 2012 concerning Juvenile Criminal Justice System Article 85 concerning the rights to education for the juveniles especially those who were in detention that were placed at Juvenile Detention Centre (LPKA). The barriers that were faced including the lack of teachers so that the time allocation of teaching were not fulfilled effectively, the lack of books at the library regarding learning and teaching support that were caused by the changes of the system that was applied by Minister of National Education, the lack of operating costs for the maintenance of music education and the purchase of the equipment of craft activity.
