Penelitian hukum ini bertujuan untuk mencari pemahan yang lebih baik dan jawaban yang jelas tentang legalitas penerapan peraturan daerah Daerah Istimewa Yogyakarta, yaitu Instruksi Wakil Gubernur No. K.898/I/A/1975 tentang Penyeragaman Policy Pemberian Hak atas Tanah Kepada Seorang WNI Non-Pribumi. Instruksi Wakil Gubernur ini dikenal sebagai kebijakan diskrimintatif karena mengelompokkan warga negara Indonesia dalam beberapa kategori, meskipun sudah ada ketentuan dalam peraturan lain yang menyatakan bahwa tindakan tersebut tidak dapat lagi dibenarkan. Penelitian hukum ini dilakukan melalui penelitian hukum normative, data yang digunakan untuk penelitian ini dikumpulkan dari studi literatur dalam bentuk buku, jurnal, artikel dan sumber-sumbel lain mengenai penerapan hukum dan aturan kebijakan. Analisis penelitian ini sangat didasarkan pada Putusan Mahkamah Agung No. 132/Pdt.G/2017/PN.Yyk yang berfokus pada Pertimbangan Hakin mengenai Instruksi Wakil Gubernur dan membandingkannya dengan teori hukum dan konsep lain yang berhubungan. Metode ini nantinya akan membantu menganalisis penerapan hukum dari Instruksi Wakil Gubernur itu sendiri, dan seberapa efektif implementasinya.

This legal research aims to seek a better understanding and a clear answer on the legality of the applicability of the Special Region of Yogyakarta policy rules, namely the Deputy Governor's Instruction No. K.898/I/A/1975 concerning the Uniformity of Policy on Granting Ownership Rights of Land to a Non-Native Citizens. The Deputy Governor's Instruction is known as a discriminative policy due to the categorization of Indonesian citizens into different types, despite provisions in other regulations stating that such action can no longer be justified. This legal research is conducted through a Normative legal research, the data for the research is collected from literary studies in a form of books, journals, articles and other sources regarding legal applicability and policy rules. The analysis of this research heavily based on the Supreme Court Decision No. 132/Pdt.G/2017/PN.Yyk focusing on the Judges' Deliberations concerning the Deputy Governor's Instruction and comparing them with legal theories and other concepts. This method will later on help analyze the legal applicability of the Deputy Governor's Instruction itself, and how effective is its implementation.
