Doktrin Imunitas Hukum sebagai Tantangan Legitimasi PBB dan Operasi Perdamaian

Peranan organisasi internasional yang semakin signifikan dalam tatanan global beberapa dekade ini mendorong adanya pergeseran fokus diskursus mengenai legitimasi, dari yang semula hanya membahas legitimasi pada institusi tingkat domestik kini memperhitungkan pula legitimasi yang hadir pada tingkat internasional, khususnya organisasi internasional (OI). Privilese imunitas hukum yang diberikan kepada OI, terutama PBB, menjadi salah satu upaya untuk melegitimasi kehadirannya sebagai institusi pemerintahan global dengan memastikan bahwa tindakan-tindakan operasional organisasi pada tingkat internasional tidak terhalang oleh sistem hukum yang bervariasi antarnegara. Kendati demikian, dalam praktiknya imunitas hukum justru menjadi instrumen untuk melanggengkan relasi kuasa yang opresif antara PBB dan konstituennya. Hal ini tampak dari penanganan berbagai isu konfliktual di mana perilaku dan tindakan operasi perdamaian PBB menjadi objek gugatan hukum di pengadilan nasional sebuah negara anggota. Kegagalan PBB dan operasi perdamaian UNPROFOR dalam mencegah genosida terhadap kelompok Muslim Bosnia di Srebrenica pada Juli 1995 menjadi salah satu kasus yang menggambarkan penggunaan imunitas hukum secara opresif. Upaya gugatan hukum yang dilakukan oleh Mothers of Srebrenica, asosiasi keluarga penyintas genosida, terhadap PBB terhalang oleh afirmasi pengadilan terhadap doktrin imunitas hukum sehingga mencegah pemenuhan hak legal. Penelitian ini kemudian bertujuan untuk menjawab bagaimana penggunaan imunitas hukum justru menjadi tantangan bagi legitimasi PBB dan operasi perdamaian dalam studi kasus sengketa hukum Mothers of Srebrenica vs UN. Ditemui bahwa imunitas hukum menghalangi PBB untuk mampu menjaga tanggung jawab moral, memberikan keuntungan bagi konstituen, serta memelihara integritas institusional. Kegagalan untuk memenuhi standar-standar tersebut lantas berakibat pada terbentuknya legitimasi sosiologis yang lemah, yakni kepercayaan sosial dari komunitas internasional bahwa PBB memiliki legitimasi yang rendah.

The increasingly significant role of international organizations in the global order has led to a shift of focus in the academic discourse of legitimacy. While legitimacy was traditionally discussed strictly in terms of domestic institutions, it is now relevant to consider the use of legitimacy on the international stage, in particular when it is attributed to international organizations (IO). The privilege of legal immunity given to IOs, especially the UN, can be seen as an effort to legitimize its presence by ensuring that the organization's international operations are not restricted by the varying legal systems of its member countries. However, in practice the use of legal immunity has been an instrument to maintain the oppressive power relations between the UN and its constituents. This is seen in conflicted issues where the misconduct of the UN's peacekeeping operations have been object to lawsuits by civilians. The failure of the UN and its peacekeeping operation UNPROFOR to prevent the genocide of Bosnian Muslims in Srebrenica, July 1995, is one particular case which highlights the opressive use of legal immunity. The lawsuit carried out by the Mothers of Srebrenica, an association of survivors of the genocide, against the UN has been obstructed by the court's affirmation towards the legal immunity doctrine. This research therefore aims to answer how the usage of legal immunity is a challenge to the legitimacy of the UN and its peacekeeping operations, particularly in the legal case of Mothers of Srebrenica vs UN. It is found that legal immunity has obstructed the UN from maintaining moral responsibility, providing comparative benefit, and preserving institutional integrity. The failure to fulfill the aforementioned standards led to weak social legitimacy, where the international community formed negative perceptions towards the UN.
