Analisis Kebijakan Pembangunan Hutan Tanaman Industri di Areal Lahan Gambut PT Riau Andalan Pulp and Paper (RAPP)

Penelitian ini bertujuan untuk mengetahui dinamika perumusan dan pencabutan sebagian pasal Peraturan Menteri Lingkungan Hidup dan Kehutanan (LHK) Nomor P.17/MENLHK/SETJEN/ KUM.1/2/2017 tentang Pembangunan Hutan Tanaman Industri (HTI) di Lahan Gambut, berisikan arahan perubahan tata ruang HTI untuk tidak menanam di area lindung gambut, sehingga perlu melakukan revisi dokumen Rencana Kelola Umum (RKU) oleh pemilik konsesi HTI. Dalam implementasinya PT. Riau Andalan Pulp and Paper (RAPP) menolak melaksanakan isi dari regulasi tersebut dengan alasan hilangnya jaminan berinvestasi. Key informan diambil dengan metode Purposive sampling meliputi Kementerian Lingkungan Hidup dan Kehutanan (KLHK), Badan Restorasi Gambut (BRG), PT. RAPP, Non-Government Organization (NGO) dan Akademisi. Pengumpulan data dilakukan dengan wawancara dan studi literatur. Penelitian ini menggunakan analisis �Siklus Perumusan Kebijakan� yang bertujuan untuk mengetahui dinamika yang terjadi dalam suatu produk kebijakan dengan menjelaskannya dalam beberapa tahapan meliputi Agenda Setting, Policy Formulation, Policy Implementation, Policy Evaluation, Policy Change, dan Policy Termination. Hasil penelitian ini menunjukan bahwa perumusan Peraturan Menteri ini dilatarbelakangi regulasi yang ada belum efektif sebagai rujukan pengelolaan gambut karena belum mengatur terkait pertanggungjawaban izin pemanfaatan lahan gambut dan kriteria lindung ekosistem gambut, proses perumusan tidak dilakukan uji publik dan harmonisasi, serta keterlibatan stakeholder dalam perumusan didominasi oleh pegiat lingkungan. Disisi lain pencabutan sebagian isi regulasi ini dilatarbelakangi dampak yang merugikan perusahaan dengan hilangnya jaminan berinvestasi serta terancamnya pekerja karena berpotensi pemutusan kerja oleh perusahaan.

This study aims to determine the dynamics of the formulation and revocation of some clause of the Ministry of Environment and Forestry Regulation number P.17/MENLHK/SETJEN/ KUM.1/2/2017 about the Development of Industrial Plantation Forests (HTI) Concession on Peatlands, contains instructions for changing spatial plan on HTI concession not to plant in peat protected areas, so it is necessary to revise the General Management Plan (RKU) document by HTI concession management. Eventually, PT. Riau Andalan Pulp and Paper (RAPP) refused to implement the contents of the regulation due to the loss of investment guarantees. Key Informans were taken by purposive sampling method included the Ministry of Environment and Forestry (KLHK), the Peat Restoration Agency (BRG), PT. RAPP, Non-Government Organizations (NGOs) and Academics. Data collection by interview and literature study. This study uses the 'Policy Formulation Cycle' analysis which aims to find out the dynamics in a policy by explaining it in several stages including Agenda Setting, Policy Formulation, Policy Implementation, Policy Evaluation, Policy Change, and Policy Termination. The results of this study indicate that the formulation of Ministerial Regulation is based on the existing regulations that have not been effective as a intruction for peat management, because they have not yet regulated the responsibility for peatland utilization permits and peat ecosystem protection criteria, the formulation process was not conducted public testing and harmonization, and stakeholder involvement in the formulation was dominated by environmental activists. On the other hand, the revocation of part of the contents of this regulation is due to the adverse impact of the company by the loss of investment guarantees and the threat of workers because of the potential for termination of employment by company.
