INTISARI Livia, Djoko Suksino Penelitian ini bertujuan untuk mengetahui dan menganalisis kesesuaian penerapan biaya jasa hukum pendirian Perseroan Terbatas bagi UMKM antara praktik dengan peraturan perundang-undangan di Kabupaten Sleman dan faktor penghambat yang mempengaruhi dengan adanya Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 8 Tahun 2018. Penelitian ini merupakan penelelitian normatif empiris dengan didasarkan atas fakta hukum yang didapat dari lapangan melalui wawancara langsung dengan narasumber dan responden, serta dilengkapi dengan data yang menyangkut materi sehubungan dengan topik penelitian sebagai data sekunder. Data-data tersebut kemudian dianalisis secara deskriptif kualitatif. Hasil yang diperoleh dalam penelitian ini adalah penerapan biaya jasa hukum pendirian PT bagi UMKM di Kabupaten Sleman dalam praktik tidak sesuai dengan peraturan perundang-undangan, praktik lebih mendasarkan pada ketentuan organisasi INI sedangkan biaya yang ditetapkan organisasi tidak sesuai dengan UUJN dan faktor internal berupa biaya-biaya operasional kantor, serta tanggung jawab yang melekat pada Notaris terhadap produk aktanya hingga purna jabatan. Tidak adanya daya paksa berupa sanksi dalam Permenkumham tersebut juga menyebabkan Notaris tidak menerapkan biaya jasa yang telah ditentukan.

ABSTRACT Livia, Djoko Suksino This study aims to understand and analyze of the suitability of the legal fees for establishing a limited liability company for Micro, Small, Medium Enterprises between practice and regulation in Sleman Regency and the inhibiting factors in the application of the regulation concerning legal fees with the existence of the Regulation of Ministry of Law and Human Rights Number 8 Year 2018. This reseacrch is a empirical juridical approach based on legal facts obtained from the field through direct interviews with the informants and respondents, and equipped with data related to the material with respect to research topics as secondary data. This data is then analyzed in qualitative descriptive. From the results of the research, it was found that the application of the legal costs of establishing a PT for Micro, Small, Medium Enterprises in Sleman Regency in practice is not in accordance with statutory regulations, the practice is more based on the provisions of the Notary organization while the fees set by the organization are not in accordance with the regulation and the inhibiting factors are the request of the client to manage the business license that is required so it will incur more fees, office operational expenses and also the responsibilty of a Notary for their deed till they’re retired. The absence of forced power in the form of sanction in the regulation also cause that notary won’t apply the specified fees that are regulated.
