KEWAJIBAN PEMENUHAN SERTIFIKAT LAIK OPERASI DALAM KONTRAK JUAL BELI EXCESS POWER PEMBANGKIT LISTRIK TENAGA SURYA ATAP ANTARA PT PLN (PERSERO) DENGAN PELANGGAN

Penelitian ini bertujuan untuk mengetahui dan menganalisis terkait kewajiban SLO terhadap pelanggan PLTS Atap sebelum terbitnya Permen ESDM 49 Tahun 2018 Tentang Penggunaan Sistem Pembangkit Listrik Tenaga Surya Atap Oleh Konsumen PT PLN (Persero) dan memberikan solusi terhadap kontrak jual beli Excess Power PLTS Atap yang telah dilaksanakan sebelum terbitnya Permen ESDM 49 Tahun 2018. Penelitian ini merupakan penelitian yang bersifat normatif empiris. Metode analisis data yang digunakan dalam penelitian ini adalah kualitatif deskriptif, yaitu dengan menggambarkan hal-hal yang terkait secara sistematis fakta-fakta yang terjadi secara faktualdan menguraikan data secara bermutu dalam bentuk kalimat yang teratur, runtut, logis, tidak tumpang tindih sehingga memudahkan interpretasi dan pemahaman hasil analisis. Hasil penelitian menunjukan bahwa SLO yang digunakan yaitu SLO eksisting (SLO tegangan rendah) yang seharusnya menggunakan SLO pembangkit dan SLO tegangan rendah tersebut sudah tidak berlaku dikarenakan masuk dalam kategori adanya perubahan instalasi. Sehingga hal ini melanggar syarat administratif sebagaimana yang telah ditentukan oleh Undang-Undang, oleh karena itu kontrak jual beli excess power PLTS Atap antara PT PLN (Persero) dengan pelanggan yang telah dilaksanakan sebelum terbitnya Peraturan Menteri ESDM Nomor 49 Tahun 2018 berpotensi untuk dapat dibatalkan. Untuk mengatasi permasalahan tersebut, harus dilakukan resertifikasi terhadap SLO bagi pelanggan PLTS Atap eksisting dan renegosiasi terhadap kontrak yang telah dilaksanakan.

The purpose expected by the writer in this research is to determine and analyze the certificates of operation worthiness (Sertifikat Laik Operasi/SLO) used in the contract of buying and selling excess power of rooftop solar power plant between PT PLN (Persero) and customers before the issuance of Minister of Energy and Mineral Resources (ESDM) Regulation No. 49 of 2018 regarding the Use of Rooftop Solar Power Generation System by consumers of PT PLN (Persero). This research is an empirical normative study. The data analysis method used in this research is descriptive qualitative, namely by describing matters that are systematically related to facts that occur factually and describing qualified data in the form of regular, coherent, logical, non-overlapping sentences so as to facilitate interpretation and understanding the results of the analysis. The results show that the SLO used has been the existing SLO (SLO of low voltage) which should not be used any more as it is included in the category of installation changes. Since this matter has violated administrative requirements as determined by the Law, the contracts of buying and selling excess power of PLTS Atap (Rooftop) between PT PLN (Persero) and customers that were implemented before the issuance of the Minister of Energy and Mineral Resources (ESDM) Regulation No. 49 of 2018, has the potential to be canceled. To overcome this problem, SLO must be recertified for existing PLTS customers and contracts that have been carried out need to be renegotiated.
