Penelitian ini bertujuan untuk untuk menelaah, mengetahui dan memahami bagaimana konsep pengaturan ketentuan norma biaya paksa dalam peraturan daerah, bagaimana implikasi ketentuan norma biaya paksa terhadap penegakan suatu norma dalam peraturan daerah dan bagaimana implikasi ketentuan norma biaya paksa terhadap asas kepastian hukum dan asas kemanfaatan pada asas umum pemerintahan yang baik Penelitian menggunakan yuridis normatif dengan menggunakan pendekatan undang-undang, pendekatan konseptual, pendekatan kasus dan pendekatan historis. Menggunakan data sekunder dan wawancara yang kemudian dianalisis dengan pendekatan kualitatif dengan metode deduktif. Hasil penelitian ini adalah merumuskan konsep biaya paksa dengan merujuk ketentuan normatif serta dibantu dengan pendekatan historis dan komparatif serta melihat praktik yang diselenggarakan oleh Pemerintah Kota Bandung dalam pelaksanaan biaya paksa. Implikasi norma biaya paksa terhadap penegakan suatu norma dalam peraturan daerah adalah memiliki keuntungan berupa Pemerintah Daerah tidak memerlukan mengeluarkan biaya atau pengeluaran, mengikat para pihak untuk tunduk, menjadi ancaman bagi para pihak, sanksi yang bersifat reparatoir, diterapkan sebagai reaksi atas pelanggaran untuk mengembalikan kepada keadaan semula. Sedangkan implikasi ketentuan norma biaya paksa terhadap asas kepastian hukum adalah terjadi reduksi dan terhadap asas kemanfaatan adalah tidak sepenuhnya menciptakan kemanfaatan.

This research aims to reviewing, knowing and understanding how the concept of regulating the provisions of forced cost norms in local regulations, what are the implications of the norms of forced costs on the enforcement of norms in regional regulations and how the implications of norms of forced costs on the principle of legal certainty and the principle of general good from good governance principles. The research uses normative juridical using a legal approach, conceptual approach, case approach and historical approach. Using secondary data and interviews which are then analyzed with a qualitative approach with deductive methods. The results of this research were to formulate the concept of forced costs by referring to normative provisions and assisted with a historical and comparative approach and to see the practices held by the Bandung Regional Government in the implementation of forced costs. The implication of the norm of forced costs towards the enforcement of a norm in regional regulations is that it has the advantage that the Regional Government does not require spending or expenses, binds the parties to submit, becomes a threat to the parties, repertory sanctions, is applied in reaction to violations at first. While the implication of the provisions of the norms of forced costs on the principle of legal certainty is that there is a reduction and the principle of expediency is not fully creating benefits.
