Perlindungan Hukum Jaminan Pesawat Udara Dengan IDERA (Irrevocable Deregistration And Export Request Authorisation)

Tujuan penelitian ini untuk mengetahui dan selanjutnya mengkaji IDERA bisa digunakan untuk memberikan perlindungan hukum kepada kreditor luar negeri apabila tetjadi wan prestasi terhadap debitur sebagai operator angkutan udara niaga dalam negeri yang dalam hal ini memerlukan peran serta Kementerian Perhubungan sebagai regulato serta mengkaji IDERA dalam memberikan jalan keluar apabila timbul perselisihan antara pemilik dan penyewa pesawat udara Metode penelitian yang diambil dari penelitian ini adalah metode penelitian yuridis normatif, yaitu metode atau cara yang dipergunakan di dalam penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Penelitian ini dilakukan di Kantor Kementerian Perhubungan-Direktorat Kelaikudaraan dan Pengoperasian Pesawat Udara di Bandara Cengkareng Soekamo-Hatta. Narasumber dari penelitian ini adalah ASN (Aparatur Sipil Negara) Direktorat Kelaikudaraan dan Pengoperasian Pesawat Udara Berdasarkan hasil penelitian, penulis menyimpulkam bahwa : Pertama, Konsep kreditur dan debitur dalam pengajuan IDERA yang tertulis dalam Staff Instruction 47- 02 secara praktek belum dapat memberikan perlindungan hukum bagi kedua belah pihak. Karena ditemukan terdapat kreditur yang berbeda dalam proses penyewaan pesawat udara, apabila terdapat wan prestasi dari salah satu kreditur terhadap kreditur lainnya, maka akan muncul perselisihan yang pada akhimya debitur yang tidak terikat dengan perjanjian diantara kreditur lainnya dirugikan. Kedua, Dengan melakukan perubahan revisi terkait proses pendaftaran pesawat udara dan IDERA dan memberikan penajaman terminology yang pada akhimya akan tercapai kesepakatan dengan pihak yang terkait sesuai dengan asas konsensualisme pada Pasal 1320 KUHP Perdata. Yang pada akhimya akan memberikan aksesbilitas bentuk perjanjian bertingkat antara kreditor dan debitor

The purpose of this research is pointed to find out and subsequently study IDERA can be used to provide legal protection to foreign creditors if there is an achievement against debtors as domestic commercial air transport operators which in this case require the participation of the Ministry of Transpoltation as regulato and review IDERA in providing solutions if a dispute alises between the owner and tenant of the aircraft. The research method taken from this study is a nonnative juridical research method, namely the method or method used in legal research conducted by examining library materials or secondary data. This research was conducted at the Ministry of Transportation Office - Directorate of Aircraft and Aircraft Operations at Cengkareng Soekamo-Hatta Airport. The sources of this research are ASN (State Civil Apparatus) Directorate of Aircraft and Aircraft Operation Based on the results of the research, the authors conclude that: First, the concept of creditors and debtors in tiling IDERA written in the 47-02 InstlUction Staff in practice cannot provide legal protection for both parties. Because there are found different creditors in the aircraft rental process, if there is an achievement from one of the creditors against other creditors, then a dispute will emerge which ultimately the debtor who is not bound by the agreement between the other creditors will be hanned. Second, by making revised changes related to the aircraft registration process and IDERA and providing refinement of tem1inology which will eventually reach agreement with the parties concerned in accordance with the principle of consensualism in Article 1320 of the Civil Code. Which in tum will provide accessibi lity to the form of a multilevel agreement between creditors and debtors
