PERAN MAJELIS PENGAWAS DAERAH DAN DEWAN KEHORMATAN DAERAH DALAM MELAKUKAN PENGAWASAN TERHADAP NOTARIS YANG TERBUKTI MEMILIKI DUA KANTOR DALAM SATU WILAYAH KERJA NOTARIS DI KABUPATEN CILACAP

Penelitian ini bertujuan untuk mengetahui dan menganalisis penyebab seorang Notaris mempunyai kantor lebih dari satu dalam satu wilayah kerja Notaris dan bagaimana peran Majelis Pengawas Daerah dan Dewan Kehormatan Daerah dalam melakukan pengawasan terhadap Notaris yang terbukti memiliki dua kantor dalam satu wilayah kerja Notaris di Kabupaten Cilacap. Penelitian ini merupakan penelitian yang berjenis yuridis empiris dan bersifat deskriptif yang didukung dengan wawancara narasumber dan responden, dilakukan untuk mendapatkan data primer yang kemudian didukung data sekunder. Seluruh data yang terkumpul dianalisis dengan metode kualitatif. Hasil penelitian menjelaskan bahwa penyebab Notaris XXX membuka kantor lebih dari satu kantor di Kabupaten Cilacap adalah karena Notaris XXX tidak mau kehilangan klien Perusahaan Leasing di Kecamatan Y sehingga berinisiatif mempermudah kliennya dengan cara membuka kantor yang tidak terdaftar agar memudahkan kliennya untuk datang ke kantor dalam penyelesaian akta yang dibuat oleh Notaris yang bersangkutan. Peran Majelis Pengawas Daerah dan Dewan Kehormatan Daerah dalam hal pengawasan terhadap Notaris yang terbukt memiliki dua kantor dalam satu wilayah kerja Notaris di Kabupaten Cilacap adalah Dewan Kehormatan Daerah bersama dengan Majelis Pengawas Daerah bersama–sama melakukan pemeriksaan kepada saksi dan Notaris XXX setelah adanya laporan kepada Dewan Kehormatan Daerah. Setelah adanya pemeriksaan, berdasarkan berita acara pemeriksaan Dewan Kehormatan Daerah Kabupaten Cilacap memberikan sanksi atas pelanggaran Kode Etik berupa sanksi peringatan kepada Notaris XXX dan memerintahkan untuk menghentikan semua kegiatan yang berkaitan dengan tugas fungsi dan jabatan Notaris yang dilakukan di kantor yang tidak terdaftar, perwakilan dan/atau bentuk lainnya.

This study aims to find out and analyze the causes of a Notary having more than one office in a Notary's work area and how the role of the Regional Watcher Council and Regional Honorary Council in supervising Notaries proven to have two offices in a Notary work area in Cilacap Regency. This research is an empirical and descriptive juridical study supported by interviews and respondents, conducted to obtain primary data which is then supported by secondary data. All data collected was analyzed by qualitative methods . The results of the study explained that the cause of Notary XXX to open more than one office in one work area in Cilacap Regency was because the Notary XXX did not want to lose the client of the Leasing Company in District Y so that Notary XXX had an initiative to opening an unregistered office to facilitate his clients to come to the office in the completion of the deed made by the Notary concerned. In addition, Notary XXX did not have to always go to an unregistered office because there is already an employee in his office to help the clients and employees themselves who will go to the registered office to ask for a signature on the deed made. The role of the Regional Watcher Council and the Regional Honorary Council in terms of supervision of the Notary that has two offices in a working area of a Notary in Cilacap Regency is the Regional Honorary Council together with the Regional Watcher Council together to examine the Notary XXX based of a report to the Regional Honorary Council. After the inspection, based on the Minutes of Examination of the Regional Honorary Council of Cilacap Regency sanctioned violations of the Code of Ethics in the form of warning sanctions to Notary XXX.
