ANALISIS TANTANGAN ASEAN INTERGOVERNMENTAL COMMISSION ON HUMAN RIGHTS (AICHR) DALAM UPAYA PERLINDUNGAN HAK ASASI MANUSIA DI KAWASAN ASIA TENGGARA

Skripsi ini membahas mengenai faktor-faktor yang melatarbelakangi kegagalan ASEAN Intergovernmental Commission on Human Rights (AICHR) dalam upaya perlindungan hak asasi manusia di kawasan Asia Tenggara. AICHR merupakan mekanisme hak asasi manusia yang dibentuk oleh Association of Southeast Asian Nations (ASEAN) yang memiliki tujuan utama untuk promosi dan proteksi hak asasi manusia. Menggunakan landasan teori institusionalisme dan konsep ASEAN way, skripsi ini menganalisa proses pembentukan AICHR sebagai institusi dibawah institusi ASEAN dan menggunakan konsep ASEAN way sebagai salah satu faktor utama yang memiliki pengaruh signifikan terhadap kegagalan AICHR. Metode pengumpulan data yang dilakukan dalam skripsi ini adalah metode pengumpulan data sekunder dari referensi ilmiah yang membahas terkait AICHR dan hak asasi manusia di Asia Tenggara. Data yang terkumpulkan kemudian diolah dengan metode kategorisasi data, yang mana data kemudian dikelompokkan kedalam dua kategori yakni kategori institusi dan kategori norma dan nilai. Berdasarkan penelitian yang telah dilakukan, skripsi ini menemukan bahwa terdapat dua faktor utama yang menjadi alasan mengapa AICHR hingga saat ini masih gagal dalam perlindungan hak asasi manusia di kawasan Asia Tenggara. Faktor pertama adalah faktor institusional yang berasal dari internal ASEAN dan AICHR, seperti struktur dan aturan dalam institusi, hingga fungsi dan mandat yang ada. Faktor kedua adalah faktor prinsipil, yaitu prinsip dan nilai-nilai dibalik norma diplomatik yang diatur dalam ASEAN way utamanya prinsip non-intervensi dan prinsip konsensus. Selain itu, skripsi ini menemukan pula bahwa terdapat hubungan saling keterkaitan antara kedua faktor tersebut yang mana kedua faktor saling memanfaatkan sebagai justifikasi atas ketetapannya.

This thesis discusses the factors behind the failure of ASEAN Intergovernmental Commission on Human Rights (AICHR) in its endeavor on protecting human rights in Southeast Asian region. AICHR is a human rights mechanism made by the Association of Southeast Asian Nations (ASEAN) that seize to promote and protect human rights. Using the institutionalism theory and the concept of ASEAN way, this thesis analyses the process of making AICHR as an institution under the institution of ASEAN and using the concept of ASEAN way as one of the main factors that has a significant impact for the failure of AICHR. The data collection method in this thesis collected from secondary data from any scientific reference that examine the topics of AICHR and human rights in Southeast Asia. The data that has been collected is categorized into two categories, which are institution and norms and values. From the research, this thesis founded that there are two main factors behind the failure of AICHR on protecting human rights in the Southeast Asian region. The first factor is an institutional factor of ASEAN and AICHR itself, including the structure and the rules within the institution, as well as the mandate and function of the institution. The second factor is a principal factor, namely the principle, and the values within the ASEAN way, particularly the principle of non-interference and principle of consensus. Moreover, this thesis discovered that there is an interplay between the two factors mentioned, in which those factors take advantage of each factor as a justification for its constancy.
