The Legal Implication Towards The Regional Representative Council After The Establishment Of The Supreme Court Decision Number 38 P/HUM/2016 And The Supreme Court Decision Number 20 P/HUM/2017

2019 | Skripsi | S1 HUKUMPada April 2017, terdapat rapat paripurna Dewan Perwakilan Daerah yang membahas tentang pembuatan Peraturan Dewan Perwakilan Daerah mengenai Tata Tertib. Rapat Paripurna tersebut dibentuk karena adanya Undang-undang Nomor 17 Tahun 2014. Hasil dari rapat paripurna tersebut adalah konflik internal antar anggota Dewan Perwakilan Daerah, hal itu dikarenakan adanya ketentuan mengenai perubahan masa jabatan Ketua Dewan Perwakilan Daerah dari 5 tahun menjadi 2,5 tahun dan penggantian Ketua Dewan Perwakilan Daerah pada saat itu tanpa dasar hukum yang jelas. Mahkamah Agung mencabut Peraturan Dewan Perwakilan Daerah tersebut melalui Putusannya Nomor 38 P/HUM/2016 dan 20 P/HUM/2017. Penelitian ini bertujuan untuk menganalisa implikasi hukum terhadap Dewan Perwakilan Daerah setelah terbitnya Putusan Mahkamah Agung tersebut. Penelitian hukum ini adalah penelitian hukum normatif dan kemudian dianalisa dengan motode kualitatif. Data yang digunakan dalam penelitian ini adalah UUD 1945, peraturan perundang-undangan, buku, jurnal, dan publikasi yang berkaitan dengan Ketua Dewan Perwakilan Daerah, anggota Dewan Perwakilan Daerah, dan Kewenangan Mahkamah Agung. Berdasarkan hasil penelitian ini, wewenang Mahkamah Agung dalam mengadili perkara ini dipertanyakan, hal tersebut dikarenakan definisi dari Peraturan Perundang-undangan yang dapat diadili oleh Mahkamah Agung tidak terpenuhi. Dan setelah terbitnya Putusan Mahkamah Agung tersebut, masa jabatan Ketua Dewan Perwakilan Daerah kembali menjadi 5 tahun, namun sayangnya konflik dalam internal anggota Dewan Perwakilan Daerah tetap ada dan hal itu terjadi dikarenakan Ketua Dewan Perwakilan Daerah yang baru dipilih tanpa dasar hukum yang jelas dan dirasa tidak adil. Konflik antar internal anggota Dewan Perwakilan Daerah masih ada sampai sekarang dan masih belum menemukan solusi.
On April 2017, there is a Regional Representative Council’s plenary session discussing about the establishment of Regulation of Regional Representative Council regarding the Rules of Procedure. The plenary session was held because there is a new Law Number 17 of 2014. The result regarding that plenary session was a conflict between the internal of the Regional Representative Council’s members, it is because there are a provision regarding the changing of the term of office of the Chief of Regional Representative Council from 5 years into 2,5 years and replaced the current Chief of Regional Representative Council without legal standing. The Supreme Court annulled that Regulation of Regional Representative Council through their Decision Number 38 P/HUM/2016 and 20 P/HUM/2017. This study aims to analyze the legal implication towards the Regional Representative Council after the establishment of those Supreme Court’s decision. This legal research is normative research and analyze by using qualitative method. Data that being used in this legal research are 1945 Constitution, legislation, books, journals and publications related to the Chief of Regional Representative Council, members of Regional Representative Council, and the Supreme Court’s authorities. According to the result of this research, the authorities of the Supreme Court on adjudicating this matter is being questionable, it is because the definition of Law and Regulation that could be adjudicated by the Supreme Court in this case is not fulfilled. And after the establishment of that Supreme Court Decisions, the term of office for the Chief of Regional Representative Council is back into 5 years, but unfortunately the conflict on the internal of Regional Representative Council’s member still exist and it is because the new Chief of Regional Representative Council is elected without legal standing and it felted not just. The conflict between the internal of Regional Representative Council still exists until now and not yet finds any solution.
