Implementasi Pengujian Konsekuensi Terhadap Informasi yang Dikecualikan Berdasarkan Perkembangan Putusan Komisi Informasi Pusat dan Putusan Pengadilan

Penelitian ini bertujuan untuk menganalisis permasalahan-permasalahan terkait implementasi pengujian konsekuensi terhadap informasi yang dikecualikan melalui perkembangan putusan Komisi Informasi Pusat dan putusan pengadilan dalam penyelesaian sengketa informasi. Ada dua jenis informasi yang disebutkan dalam Undang-Undang Keterbukaan Informasi Publik, antara lain informasi yang wajib disediakan dan diumumkan serta informasi yang dikecualikan. Badan Publik wajib untuk menyediakan informasi publik akan tetapi disaat yang bersamaan dapat pula menutup atau menolak untuk memberikan informasi tersebut dengan alasan prosedural maupun alasan substantif yang menyatakan informasi merupakan informasi yang dikecualikan. Permasalahanya, dalam hukum positif saat ini belum dijelaskan secara detil bagaimana prosedur pengujian konsekuensi dan penjelasan lebih lanjut mengenai alasan pengecualian informasi tersebut. Beberapa Putusan Komisi Informasi Pusat menunjukkan adanya perbedaan pendapat antara Badan Publik dengan Komisi Informasi dalam menafsirkan makna pengecualian informasi serta tidak dilaksanakannya uji konsekuensi sebagaimana diperintahkan Undang-Undang. Permasalahan lebih lanjut terjadi dengan adanya Putusan Komisi Informasi Pusat yang dibatalkan melalui badan peradilan melalui upaya keberatan dan kasasi. Penelitian ini merupakan penelitian hukum normatif dengan bahan hukum sekunder. Melalui enam putusan yang dibahas dalam penelitian ini ditemukan tiga putusan yang menunjukkan Badan Publik keliru dalam menafsirkan prosedur uji konsekuensi, empat putusan Badan Publik yang keliru dalam menafsirkan makna informasi yang dikecualikan, empat putusan Komisi Informasi Pusat yang dikuatkan oleh pengadilan serta dua putusan Komisi Informasi Pusat yang akhirnya dibatalkan.

This study aims to analyze the problems related to the implementation of examining the consequences of excluded information based on the development of decisions of the central information commission and court decision in resolving information disputes. There are two types of information in Public Disclosure Information Act such as announced information and excluded information. Public institutions are obligated to provide public information yet, in another hand, public institutions could also close or refuse to provide such information with both procedural reasons and substantive reason in terms of excluded information. The problem is the positive law has not been explained in detail of how the procedure regarding the consequences and further explanation of the reasons for the exclusion of the information. Several Decisions by the Commission of Information indicate that there is a difference of opinion and interpretation between the Public institutions and the Commissioner of the Information Commission in interpreting the meaning of the exceptional information and the failure to carry out the consequential test as ordered by the Law. Further problems occurred with the decision of the Central Information Commission which was annuled by the court through an objection and appeal. This research is normative legal research with secondary legal source. Based on the six decisions discussed in this study, there are three decisions were found that public institutions were incorrect in interpreting the consequential test procedure, four decisions that were incorrect in interpreting the meaning of the exempt information, four Central Information Commission decisions that were upheld by the supreme court and two Central Information Commission decisions which were finally annuled.
