Penerapan Asass Itikad Baik dan Perlindungan Hukum Dalam Pelaksanaan Perjanjian Kerjasama Program Khusus Condotel Swiss Bel-Hotel Kuta-Bali antara PT Royal Premier International dan Investor Penulisan Hukum ini membahas penerapan prinsip itikad baik dalam pelaksanaan Perjanjian Program Kerjasama Condotel Swiss Bel-Hotel Kuta-Bali antara PTRoyal Premier International dan Investor. Selain itu, Penulisan Hukum membahas perlindungan hukum bagi investor internal. Penelitian ini bertujuan untuk mendapatkan pemahaman tentang penerapan prinsip itikad baik dalam perjanjian kerja sama investasi kondotel antara pihak pemasaran dan investornya dan untuk menemukan perlindungan yang ideal untuk memastikan kepastian hukum bagi para pihak. Penelitian ini dilakukan dengan menggunakan metode penelitian normatif-empiris. Metode penelitian normatif dilakukan sehingga penulis dapat meneliti lebih dalam prinsip-prinsip itikad baik dan perlindungan hukum bagi investor baik dari hukum dan doktrin Indonesia. Penelitian empiris dilakukan untuk mengetahui penerapan prinsip itikad baik dan perlindungan hukum dalam pelaksanaan Perjanjian Kerjasama Program Khusus Swiss Bel-Hotel Kuta-Bali Condotel antara PT Royal Premier International dan Investor. Hasil penelitian ini menunjukkan bahwa (1) prinsip itikad baik tidak diterapkan dalam pelaksanaan Perjanjian Kerjasama Program Khusus Swiss Bel- Hotel Kuta-Bali Condotel antara PT Royal Premier International dan Investor karena default yang dilakukan oleh PT Royal Premier Internasional (2) perlindungan hukum untuk DBS dapat diterapkan dalam bentuk perlindungan hukum preventif dan represif. Perlindungan hukum preventif untuk DBS adalah dalam bentuk klausul dalam perjanjian lengkap. Perlindungan hukum represif bagi "DBS" adalah dalam bentuk penyelesaian sengketa hukum baik dari pidana dan perdata.

The Implementation of Good Faith Principle and Legal Protection in the Implementation of Swiss Bel-Hotel Kuta-Bali Condotel Special Program Cooperation Agreement between PT Royal Premier International and Investor This Legal Writing discusses the application of good faith principle in the implementation of Swiss Bel-Hotel Kuta-Bali Condotel Special Program Cooperation Agreement between PT Royal Premier International and Investors. Further, this Legal Writing discusses legal protection for internal investors. This study aims to gain an understanding of the implementation of good faith principle in a condotel investment cooperation agreement between the marketing parties and the investors and to find an ideal protection to ensure legal certainty for the parties. This research was conducted using empirical-normative research methods. Normative research method was conducted out so that the writer can deeply examines the good faith principle and the legal protection for investors from both Indonesian law and doctrines. Empirical research was conducted to determine the application of good faith principle and legal protection in the implementation of Swiss Bel-Hotel Kuta-Bali Condotel Special Program Cooperation Agreement between PT Royal Premier International and Investors. The results of this study indicate that (1) the good faith principle was not applied in the implementation of Swiss Bel-Hotel Kuta-Bali Condotel Special Program Cooperation Agreement between PT Royal Premier International and Investors because of the defaults conducted by PT Royal Premier International (2) the legal protection for DBS can be implemented in the form of preventive and repressive legal protection. Preventive legal protection for DBS is in the form of clauses in a complete agreement. Repressive legal protection for DBS is in the form of legal dispute resolution both from criminal and civil.
