PENGAWASAN DPRD DIY TERHADAP PEMERINTAH DAERAH DALAM PENGGUNAAN DANA KEISTIMEWAAN

Penelitian ini bertujuan untuk mengkaji dan menganalisis pengawasan yang dilakukan DPRD DIY terhadap Pemerintah Daerah dalam penggunaan Dana Keistimewaan beserta tindak lanjut yang dilakukan DPRD DIY dalam pelaksanaan pengawasan tersebut. Selain itu, penelitian ini juga bertujuan untuk mengkaji dan menganalisis faktor-faktor yang menghambat DPRD DIY dalam melaksanaan pengawasan terhadap Pemerintah Daerah dalam penggunaan Dana Keistimewaan dan upaya-upaya yang dilakukan untuk mengatasi hambatan tersebut. Penelitian ini adalah penelitian hukum normatif empiris, yaitu penelitian hukum normatif yang ditunjang dengan penelitian hukum empiris. Data dalam penelitian ini meliputi data primer dan data sekunder, yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Data yang diperoleh kemudian diolah secara kualitatif dan dianalisis secara deskriptif preskriptif. Hasil dari penelitian ini menunjukkan pelaksanaan pengawasan yang dilakukan oleh DPRD DIY terhadap Pemerintah Daerah dalam kaitannya dengan penggunaan Dana Keistimewaan masih belum bisa dilaksanakan secara optimal. Hal ini karena DPRD DIY kurang mengetahui informasi seputar Dana Keistimewaan yang akan diawasi. Di samping itu, tindak lanjut dari pelaksanaan pengawasan DPRD DIY tersebut juga belum signifikan sebabnya DPRD DIY tidak berani menggunakan hak interpelasinya. Pengawasan yang dilakukan oleh DPRD DIY masih menemui hambatan seperti aspek regulasi, hambatan internal, dan mekanisme penyampaian informasi seputar Dana Keistimewaan oleh pemerintah daerah yang masih kurang. Dalam mengatasi hambatan-hambatan tersebut, DPRD DIY memasukkan klausul dalam Peraturan Daerah Istimewa agar lembaganya dapat berkontribusi dalam perencanaan Dana Keistimewaan bersama pemerintah daerah. Selain itu, DPRD DIY juga mengikutinya dengan meningkatkan sikap disiplin, taat pada tata tertib dan kode etik, serta melakukan komunikasi secara lebih intensif dengan pemerintah daerah. This research is intended to study and analyze the supervision performed by Special Region of Yogyakarta's Regional House of Representative toward Local Goverment's use of Yogyakarta's Specialty Fund and its follow-up actions in terms of the supervision. Also, the research aims to study the challenges faced by Yogyakarta's Regional House of Representative in performing its supervision, as well as its solutions to overcome the challenges. This research belongs to empirical normative law research, which means as a normative law research supported by empirical law research. The research employs both primary data and secondary data, derived from primary source of law, secondary source of law, and tertiary source of law. The collected data was then processed by employing qualitative method, and then analyzed by using descriptive prescriptive method. The result of the research describes that the supervsion performed by Special Region of Yogyakarta's Regional House of Representative on the use of Yogyakarta's Specialty Fund has not been optimal yet. This result is due to (1) the House of Representative Special Region of Yogyakarta lacks information regarding the Specialty Fund; (2) the follow-up action by House of Representative of Special Region of Yogyakarta is not significant, as the House of Representative hesitates to use its interpellation right; (3) the supervision performed by House of Representative of Special Region of Yogyakarta faces several obstacles, such as in term of the regulation, internal challenges, and the mechanism of information communication of the Specialty Fund is not yet optimal. In overcoming the challenges, House of Representative of Special Region of Yogyakarta gives clausul in the local regulation of Special Region of Yogyakarta in order it will contribute optimally in the planning process of Yogyakarta's Specialty Fund, along with the Local Government. Besides, House of Representative of Special Region of Yogyakarta also follows up its action by increasing the disciplinary actions, obeying the regulations and ethical code, and also performing an intensive communication with the Local Government.
