INTISARI PERLINDUNGAN HUKUM TERHADAP DOKTER DAN PERAWAT PADA PELAYANAN DI RUANG INTENSIVE CARE UNIT (ICU) RUMAH SAKIT UMUM DAERAH PALAGIMATA KOTA BAUBAU Oleh : Daryam Dafid dan Rimawati Penelitian ini bertujuan untuk mengetahui dan mengkaji faktor-faktor yang melatarbelakangi adanya permasalahan medis pada pelayanan di Intensive Care Unit (ICU) Rumah Sakit Daerah Palagimata Kota Baubau dan penerapan perlindungan hukum bagi dokter dan perawat pada Pelayanan di Intensive Care Unit (ICU) Rumah Sakit Umum Daerah Palagimata Kota Baubau. Penelitian ini bersifat deskriptif dengan jenis penelitian yuridis empiris. Bahan penelitian yang digunakan adalah data sekunder dan data primer. Data sekunder diperoleh dari 3 (tiga) bahan hukum yaitu bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier sedangkan data primer diperoleh dari studi lapangan yaitu dari responden dan narasumber. Cara penelitian dengan mengumpulkan, membaca dan menelaah data sekunder serta melakukan wawancara terstruktur terhadap subyek penelitian, sedangkan alat yang digunakan adalah dokumen dan pedoman wawancara. Data selanjutnya dianalisis dengan teknik kualitatif. Hasil penelitian menunjukkan bahwa faktor � faktor yang melatarbelakangi adanya permasalahan medis pada pelayanan di Intensive Care Unit (ICU) Rumah Sakit Umum Daerah Palagimata Kota Baubau di antaranya adalah belum terlaksananya standar dalam pelayanan pada ruang ICU RSUD Kota Baubau; keterbatasan sarana dan prasarana. Penerapan perlindungan hukum bagi dokter dan perawat pada Pelayanan di Intensive Care Unit (ICU) Rumah Sakit Umum Daerah Palagimata Kota Baubau belum sepenuhnya dilaksanakan oleh RSUD Kota Baubau. Hal ini disebabkan oleh RSUD Kota Baubau belum memiliki Komite Medis yang seharusnya memiliki kewenangan dalam melakukan kredensialing terhadap kopetensi tenaga medis di rumah sakit. Sementara komite keperawatan yang ada di RSUD juga belum maksimal melaksanakan kewenangannya. Dokter dan perawat yang bertugas sebagai tim intensive care di ruang ICU membutuhkan kompetensi khusus yang dituntut untuk menjalankan SOP pada ruang ICU yang berbeda dengan SOP pada ruang perawatan lainnya di rumah sakit. ABSTRACT LEGAL PROTECTION OF DOCTOR AND NURSE WHO WORKS IN INTENSIVE CARE UNIT AT PUBLIC HOSPITAL OF PALAGIMATA MUNICIPALITY OF BAUBAU By Daryam Dafid and Rimawati This study aimed to determine and examine the factors underlying the existence of medical problems in the service in the Intensive Care Unit (ICU) of Public Hospital of Palagimata and the implementation of legal protection for doctors and nurses at the Intensive Care Unit (ICU) of Public Hospital of Palagimata Municipality of Baubau. This research were descriptive and juridical research. The research material used secondary and primary data. Secondary data were obtained from 3 (three) legal materials, namely primary legal materials, secondary legal materials and tertiary legal materials, while primary data were obtained from field studies, namely from research subjects. The method of research was by collecting, reading and reviewing secondary data and conducting structured interviews with research subjects, while the tools used are interview documents and guidelines. Subsequent data were analyzed with qualitative techniques. The results showed that the factors underlying the existence of medical problems in the service in the Palagimata Regional General Hospital Intensive Care Unit (ICU) were not yet implemented in the service standard at RSUD Palagimata; limited facilities and infrastructure. The implementation of legal protection for doctors and nurses at the Service in the Intensive Care Unit (ICU) of the RSUD Palagimata has not been fully implemented yet, because the RSUD does not have a Medical Committee which should have the authority to carry out credence to the competence of medical personnel in the hospital. Even the nursing committee in the RSUD Palagimata also has not maximally exercised its authority. Doctors and nurses on duty as intensive care teams in the ICU require special competencies that are required to run SOPs in the ICU that are different from SOPs in other treatment rooms in the hospital.
