IMPLIKASI PENGATURAN PRESIDENTIAL THRESHOLD DALAM UNDANG-UNDANG NOMOR 7 TAHUN 2017 TENTANG PEMILIHAN UMUM TERHADAP KEDUDUKAN PRESIDEN DAN WAKIL PRESIDEN DALAM SISTEM PEMERINTAHAN PRESIDENSIIL

Penelitian ini bertujuan untuk mengetahui relevansi ketentuan presidential threshold dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum pada pelaksanaan Pemilihan Umum serentak, dan untuk mengetahui implikasi pengaturan presidential threshold dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum terhadap kedudukan Presiden dan Wakil Presiden dalam sistem pemerintahan presidensiil. Penelitian ini merupakan penelitian normatif. Penelitian normatif dilakukan dengan cara meneliti bahan pustaka atau data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, bahan hukum tersier. Meskipun merupakan penelitian normatif, penelitian ini dilengkapi dengan data primer berupa hasil wawancara kepada narasumber yaitu, Denny Indrayana, selaku Kuasa Hukum pihak pemohon dalam perkara Judicial Review di Mahkamah Konstitusi dengan Nomor Perkara 49/PUU-XVI/2018 terkait dengan pengujian Pasal 222 Undang-Undang No 7 Tahun 2017 tentang Pemilihan Umum. Data dianalisis dengan menggunakan metode kualitatif yang merupakan kegiatan sistemasi dan klarifikasi terhadap dokumen dan hasil wawancara yang diperoleh dalam penelitian sesuai dengan rumusan masalah dan dipaparkan secara deskriptif. Berdasarkan penelitian yang ada, hasilnya adalah sebagai berikut: Pertama, bahwa ketentuan presidential threshold tidak lagi relevan digunakan dalam sistem Pemilu serentak. Hal ini disebabkan tidak terdapat lagi acuan dalam menghitung ambang batas. Berbeda dengan sistem Pemilu tidak serentak dimana Pemilu DPR dilaksanakan terlebih dahulu dan kemudian hasilnya digunakan sebagai presidential threshold. Kedua, Pengaturan presidential threshold dalam Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum, justru berpotensi melemahkan kedudukan Presiden dan Wakil Presiden dalam sistem pemerintahan presidensiil, karena tidak ada jaminan bahwa partai politik pengusung Presiden dan Wakil Presiden akan mendapatkan suara yang sama di DPR dengan suara hasil dari Pemilu 5 (lima) tahun sebelumnya.

The purpose of this research is to determine the relevancy of the presidential threshold regulation under Law No. 7 of 2017 on General Elections in the implementation to direct general elections and to find out the implications of such law towards the position of the president and vice president in the presidential government system. This research is conducted through a normative legal research. The normative research was conducted by analyzing literature or secondary data consisting of primary, secondary, and tertiary legal materials. Although it is a normative research, this research is equipped with primary data in the form of interviewed with interviewee, Denny Indrayana, as the Legal Counsel of the applicant on Judicial Review case in the Constitutional Court with Case Number 49 / PUU-XVI / 2018 related to Article 222 Law Law No. 7 of 2017 about General Elections. The data were analyzed using qualitative methods which systemization and clarification to the documents and interview result according to the research problems and explained descriptively. Based on the research, the results are: First, that the provisions of the presidential threshold are no longer holds relevant to be used in the concurrent election system. This is due to no longer a reference in calculating the threshold. Different from non concurrent election system where the DPR Election held first and then the results used as the presidential threshold. Second, the regulation of the presidential threshold in Law Number 7 of 2017 on General Elections has the potentially weaken the position of the President and Vice President in a presidential government system, because there is no guarantee that political parties that carrying the President and Vice President will get the same vote in the DPR with a vote results of the Election 5 (five) years before.
