TINJAUAN HUKUM PERAN LEMBAGA KONSERVASI MUSEUM BIOLOGI UNIVERSITAS GADJAH MADA DALAM PELESTARIAN KEANEGARAGAMAN SATWA YANG DILINDUNGI INTISARI Oleh: *Leonard Andy Tukan ** dan Totok Dwi Diantoro Peraturan Menteri Kehutanan Nomor P.31/Menhut-II/2012 tentang Lembaga Konservasi mensyaratkan untuk dapat dikategorikan sebagai Lembaga Konservasi suatu lembaga pemerintah maupun non pemerintah harus membuat izin kepada Kementerian Lingkungan Hidup dan Kehutanan. Pelaksanaan suatu Lembaga Konservasi pada umumnya tidak memiliki surat izin dari Kementerian Lingkungan Hidup dan Kehutanan sehingga diperlukan penelitian bagaimana peran suatu Lembaga Konservasi terhadap perlindungan keanekaragaman satwa yang dilindungi dan kendala dalam perlindungan keanekaragaman satwa yang dilindungi. Dalam penulisan ini penulis memilih Lembaga Konservasi Museum Biologi Universitas Gadjah Mada Yogyakarta dikarenakan meskipun merupakan suatu bentuk Lembaga Konservasi namun belum memiliki izin dari kementerian. Cara penelitian menggunakan pendekatan Normatif-Empiris. Penelitian bersifat Normatif adalah pendekatan permasalahan menggunakan penelitian kepustakaan dengan memeperoleh data sekunder berupa literatur yang bersumber dari bahan hukum primer, sekunder, dan tersier. Disisi lain juga menggunakan pendekatan empiris, yaitu penelitian menggunakan data primer, data primer diperoleh dari hasil wawancara dengan responden. Berdasarkan hasil penelitian yang dilakukan oleh penulis ternyata telah ditemukan Lembaga Konservasi Museum Biologi Universitas Gadjah Mada tidak memilik izin dari Kementerian Lingkungan Hidup dan Kehutanan. Hal demikian sebagai akibat dari kurangnya pengetahuan tentang perizinan sebagai suatu Lembaga Konservasi. Diperlukan pengetahuan tentang pembuatan perizinan sebagai Lembaga Konservasi agar kegiatan yang dilakukan Museum Biologi Univeritas Gadjah Mada dinyatakan legal.

Legal Review of the Role of the Museum of Biology’s Coservation Organization of Gadjah Mada University in the Preservation of Protected Biodiversitry ABSTRACT By: *Leonard Andy Tukan ** And Totok Dwi Diantoro The regulation of Minister of Forestry Number P.31/Menhut-II/2012 about Conservation Organization requires that to be categorized as Conservation Organization, government or non-governmental institutions have to ask the authorization to the Ministry of Environment and Forestry. In most cases, the execution of a Conservation Organization did not own the license of Ministry of Environment and Forestry so that a research is needed, on what is the role of a Conservation Organization towards the protection of the diversity of protected animals. In this writing, the writer chose the Museum of Biology’s Conservation Organization of Gadjah Mada University Yogyakarta which is a configuration of a Conservation Organization. However, it has not owned the license from the ministry. The method which is used in this research is the Normative-Empirical approach. A Normative research is a problem approach that uses literature research by obtaining the secondary data in the form of literature which is sourced from primary, secondary, and tertiary legal material. On the other side, there is also the use of Empirical approach which is a research that uses primary data. The primary data are obtained from the interviews with the respondents. Based on the research result which is done by the writer, it turns out that the Museum of Biology’s Conservation Organization of Gadjah Mada University has not owned the license from Ministry of Environment and Forestry yet. It happened because the lack of the awareness about licensing for a Conservation Organization. The awareness about licensing for a Conservation Organization is needed so that the actions which are conducted by Museum of Biology of Gadjah Mada University will be declared as legal actions.
