PENGAMBILAN KEPUTUSAN PENYIDIK POLRI PADA SITUASI BERISIKO: STUDI KASUS PADA PENYIDIKAN KASUS BTP

Kepolisian Negara Republik Indonesia (Polri) merupakan tahapan awal dalam sistem peradilan hukum pidana di Indonesia. Proses penegakan hukum diawali dengan proses penyidikan. Penyidikan dilakukan guna membuat terang suatu tindak pidana dan terciptanya keadilan. Dalam mewujudkan penegakan hukum yang professional dan adil maka keputusan penyidik haruslah tepat. Keputusan penyidik akan memberikan dampak secara langsung kepada masyarakat. Penyidik diharuskan dapat mengambil keputusan sesuai dengan fakta-fakta hukum yang ada tanpa terpengaruhi tendensi tertentu, terutama pada saat situasi berisiko. Keputusan tidak boleh diambil berdasarkan tekanan situasi atau intervensi dari pihak tertentu. Penelitian ini dilakukan dengan tujuan untuk mengetahui proses pengambilan keputusan yang dilakukan oleh penyidik kasus BTP serta proses yang mempengaruhinya. Pengumpulan data dilakukan dengan metode kualitatif. Penelitian dilaksanakan di Badan Reserse Kriminal Markas Besar Kepolisian Negara Republik Indonesia (Bareskrim Polri). Subjek adalah penyidik Bareskrim Polri yang secara langsung melakukan pemeriksaan terhadap BTP. Data menunjukan bahwa penyidikan dilakukan dengan baik. Kaputusan penyidik selama proses penyidikan tidak terpengaruh oleh faktor-faktor personal-matter. Penyidik dalam proses penyidikan mamiliki kemampuan dalam mengendalikan emosi. Tidak terlibatnya faktor personal-matter dan kemampuan pengendalian emosi merupakan hasil dari sejarah diri, modeling dan dukungan sosial. Penyidik dengan kondisi ini mampu mengambil keputusan secara logis sesuai dengan fakta-fakta hukum yang ada tanpa tendensi pribadi maupun intervensi orang lain, bahkan ketika dalam situasi berisiko.

Indonesian National Police (Polri) is the first stage in the criminal law justice system in Indonesia. The law enforcement process begins with the investigation process. The investigations are carried out to make criminal offense clearly and the creation of justice. By realizing professional and fair law enforcement, the decision from the investigators must be appropriate. The decision from the investigator will give impact directly to citizens. The Investigators must be able to make decisions regarding to the existing law facts without being influenced by certain tendencies, especially in a risky situation. The decision can not be taken based on the pressure of the situation or intervention from certain parties. The aim of this research is conducted to determine the decision-making process that is carried out by BTP case investigators and the process that influence in this case. The data collection is done by using qualitative methods. The research is carried out at the Badan Reserse Kriminal Polri (Bareskrim Polri). The respondents are investigators from the National Police Criminal Investigation Unit whom directly examined through BTP. The data shows that investigation goes smoothly. The decision from the investigator during the investigation process is not affected by personal-matter factors. The Investigators in the investigation process have the ability to control their emotions. Uninvolved of personal-matter factors and the ability of emotional control are the result of self history, modeling and social support. The investigators with this condition are able to make decisions logically according to the existing law facts without personal tendencies or interventions from others, even though in a risky situation.
