LARANGAN PERSEKONGKOLAN TENDER SEKTOR JASA KONSTRUKSI MENURUT PASAL 22 UNDANG-UNDANG NOMOR 5 TAHUN 1999 (STUDI KASUS PUTUSAN KPPU NOMOR 06/KPPU-L/2014, PUTUSAN KPPU NOMOR 06/KPPU-L/2015, DAN PUTUSAN KPPU NOMOR 06/KPPU-L/2016)

Penelitian hukum ini untuk mengetahui dan menganalisa Putusan KPPU Nomor 06/KPPU-L/2014, Putusan KPPU Nomor 06/KPPU-L/2015, Dan Putusan KPPU Nomor 06/KPPU-L/2016 telah sesuai dengan ketentuan perundang-undangan yang berlaku, serta mengetahui konsekuensi hukum bagi Pelaku usaha dan Pihak lain dalam hal ini yaitu Panitia lelang/tender yang terbukti melanggar Pasal 22 Undang-undang Nomor 5 Tahun 1999. Penelitian hukum ini merupakan penelitian hukum yuridis normatif, dalam penelitian ini Penulis menggunakan bahan-bahan hukum primer dan bahan hukum sekunder. KPPU dalam memutus Putusan KPPU Nomor 06/KPPU-L/2014, Putusan KPPU Nomor 06/KPPU-L/2015, telah memenuhi unsur-unsur Pasal 22 UU Nomor 5 Tahun 1999, namun khusus terhadap Putusan KPPU Nomor 06/KPPU-L/2014 KPPU tidak mempertimbangkan unsur Pasal 17 ayat (6) Undang-undang Nomor 18 Tahun 1999, sedangkan tender tersebut bergerak pada sektor Jasa Konstruksi. KPPU telah salah dalam menghitung besaran sanksi denda dan menerapkan Peraturan Komisi No. 4 Tahun 2009 dalam Putusan KPPU Nomor 06/KPPU-L/2014, Putusan KPPU Nomor 06/KPPU-L/2015, Dan Putusan KPPU Nomor 06/KPPU-L/2016, serta tidak adanya peraturan perundang-undangan yang mengatur konsekuensi hukum Panitia Lelang/Tender. Majelis KPPU harus mempertimbangkan seluruh peraturan perundang-undangan yang ada guna mempertimbangkan penjatuhan hukuman sanksi termasuk namun tidak terbatas, sanksi berupa denda. Perlunya perubahan Peraturan Komisi Nomor 4 Tahun 2009, khususnya mengenai penegasan persentase penentuan nilai denda dasar dan pengurangan denda, selain hal tersebut perlunya ada peraturan komisi atau peraturan perundang-undangan yang mengatur konsekuensi hukum Panitia Lelang/Tender yang terbukti melanggar Pasal 22 Undang-undang Nomor 5 Tahun 1999 agar tidak terjadi kekosongan hukum.

The law study in this Thesis is aimed to provide knowledge and to analyze KPPU Decree Number 06/KPPU-L/2014, KPPU Decree Number 06/KPPU-L/2015, And KPPU Decree Number 06/KPPU-L/2016, that are in line with existing law/regulation and also to provide knowledge on legal consequences for business actors and other parties, in this case the tender committee who violate Chapter 22 Law Number 5/1999. This Thesis is a normative juridical legal research, the author used primary and secondary law materials. KPPU in issuing KPPU Decree Number 06/KPPU-L/2014, KPPU Decree Number 06/KPPU-L/2015, And KPPU Decree Number 06/KPPU-L/2016, KPPU has fulfilled the elements of Chapter 22 Law Number 5/1999, but especially to KPPU Decree Number 06/KPPU-L/2014, the KPPU have not considered the elements of Chapter 17 paragraph (6) Law No. 18/1999, mean while the tender is in Services and Construction Sector. KPPU has made a mistake in calculating the amount of fine sanction and in implementing Commission Regulation no. 4/2009 in KPPU Decree Number 06/KPPU-L/2015, KPPU Decree Number 06/KPPU-L/2016, more over the regulation on Tender Comnmittee legal consequences its not available yet. The KPPU Assembly has to consider the whole existing law regulation in order to consider the sanction punishment decision including but not limited, fine sanction therefore amendment of Commission Regulation Number 4/2009, especially on the calculation of basic fine value percentage, and fine deduction, more over the commission regulation or law/regulation on Tender Committee legal Consequences who violate chapter 22 Law Number 5/1999 to avoid the inavailability of law.
