Fungsi dan Wewenang Kecamatan Dalam Penyelenggaraan Pemerintahan Daerah Di Kabupaten Lombok Tengah, Provinsi Nusa Tenggara Barat

Tesis ini membahas tentang fungsi dan wewenang kecamatan dalam penyelenggaraan pemerintahan daerah di Kabupaten Lombok Tengah, Provinsi Nusa Tenggara Barat. Tesis ini bertujuan untuk menjawab tiga pokok masalah, diantaranya: Pertama, Bagaimana fungsi dan wewenang kecamatan dalam penyelenggaraan pemerintahan daerah di Kabupaten Lombok Tengah? Kedua, Mengapa Bupati Lombok Tengah mendelegasikan sebagaian urusan otonomi daerah kepada kecamatan? dan Ketiga, Bagaimana kecamatan di Kabupaten Lombok Tengah mengimplementasikan fungsi dan wewenang yang diberikan oleh UU No. 32 Tahun 2014 Bupati Lombok Tengah tersebut? Tesis ini juga menempuh beberapa metode penelitian, diantaranya: pengumpulan data ditempuh melalui observasi dan wawancara mendalam, data diklasifikasikan menjadi data primer dan data sekunder, sumber hukum diklasifikasikan menjadi sumber hukum pimer, sekunder dan sumber hukum tersier. Selain itu, Tesis ini juga menggenal populasi dan sampel penelitian, subyek dan obyek penelitian, dan analisis deduktif dan induktif. Dari metode ini kemudian peneliti mendapatkan beberapa kesimpulan penelitian, yakni, di Kabupaten Lombok Tengah, Camat memiliki 3 (tiga) fungsi dalam penyelenggaraan pemerintahan daerah diantaranya: Pertama, Camat berfungsi sebagai pemimpin wilayah administrasi pemerintahan di tingkat kecamatan; Kedua, Camat berfungsi sebagai koordinator dalam mewujudkan tertib pemerintahan di tingkat wilayah administrasi kerja kecamatan; dan Ketiga, Camat berfungsi sebagai perangkat atau pembantu Bupati Lombok Tengah dalam menjalankan otonomi daerah di tingkat kecamatan. Alasan Bupati Lombok Tengah mendelegasikan sebagian urusan otonomi daerah kepada Camat di Kabupaten Lombok Tengah: Pertama, adanya ketentuan dalam Pasal 1 angka (5) Peraturan Bupati Lombok Tengah Nomor 22 Tahun 2015 tersebut, yang mengatur tentang 3 (Tiga) fungsi kecamatan di Lombok Tengah itu. Kedua, keanekaragaman kondisi kecamatan di Kabupaen Lombok Tengah. Ketiga, kuatnya para Camat menyampaikan keluh-kesahnya kepada Bupati Lombok Tengah mengenai berbagai permasalahan yang dihadapi hari ini oleh kecamatan. Ketiga, untuk mempercepat pelayanan masyarakat dan kesejahteraan rakyat.

This thesis discusses the function and authority of the district in Indoneisa governance, especially in Central Lombok Regency, West Nusa Tenggara Province. The thesis purposed to respond on three main issues: Firstly, what is the function and authority of the sub-district in the implementation of local government in Central Lombok regency, West Nusa Tenggara Province? Secondly, why does the Regent of Central Lombok delegate the role of regional autonomy to the district? and Third, how the district in Central Lombok regency run or implement the functions and authority given by Law no. 32 Year 2014, and the functions and authorities delegated by the Central Lombok Regent? Research methods, including: data collection through observation and in-depth interviews, data classified into primary and secondary data, legal sources are classified into primer legal sources, secondary and tertiary legal sources. In addition, the Thesis also identifies populations and research samples, subjects and research objects, and deductive and inductive analyzes. The head of district (Camat) has 3 (three) functions in organizing regional government such as: First, the head of district serves as a leader of the administrative area of governmen; Secondly, the head of district serves as the coordinator in realizing the order of governance at the administrative of the district; and Third, the head of district serves as a auxiliary of the Regent of Central Lombok in carrying out regional autonomy at the sub-district level. Meanwhile, the authority of the district in Central Lombok regency, namely: First, run the affairs of general government. Second, the Regional Leadership Coordination Forum (Forum Koordinasi Pimpinan Daerah) at the District and Village levels. Third, running part of the regional autonomy affairs delegated by the Central Lombok Regent. The reason for the Regent of Central Lombok delegates part of the authority of regional autonomy to District is First, the provision of Article 1 number 5 of Central Lombok Regent Regulation No. 22 of 2015. Second, the diversity of districts in Central Lombok Regency. Thirdly, is to accelerate community service and people's welfare.
