MENJADI UMAT NEGARA : STUDI KASUS PERJUANGAN INKLUSIFITAS ALIRAN KEPERCAYAAN MELALUI JUDICIAL REVIEW UNDANG-UNDANG ADMINISTRASI KEPENDUDUKAN DI MAHKAMAH KONSTITUSI

Perjuangan hak warga negara oleh kelompok aliran kepercayaan melalui Judicial Review (JR) Undang-undang Administrasi Kependudukan (Adminduk) No.23 Tahun 2006 sebagaimana diubah dalam Undang-undang Administrasi Kependudukan (Adminduk) No.24 Tahun 2013 telah mengulik perspektif sektarian negara yang bertindak sebagai lembaga umat bayangan dalam mengelola kewarganegaraan. JR UU Adminduk yang terlihat sebagai pergolakan minoritas dalam level lokal mengandung gejala wacana yang bekerja pada level global, yaitu tren komitmen terhadap demokrasi sebagaimana ditunjukan oleh fokus JR UU Adminduk pada perwujudan inklusifitas. Inklusifitas merupakan perhatian penting dalam konsep Robert A. Dahl sebagaiamana Demokrasi Poliarki-nya yang terdiri atas dua elemen utama, yaitu : inklusifitas dan kompetisi, sedangkan upaya pengongkritan kedua elemen tersebut dapat ditempuh melalui tiga upaya, antara lain: 1)warga negara harus mempunyai kesempatan merumuskan preferensi-preferensi mereka; 2)memberitahukan preferensi mereka kepada teman senegara dan pemerintah baik secara individual maupun tindakan kolektif;.dan 3)mengusahakan agar preferensi-preferensi mereka dipertimbangkan secara setara serta sebisa mungkin diskriminasi terhadap preferensi-baik karena konten maupun asal-usul preferensi tersebut- dihindari atau dicegah. Riset merupakan penelitian kualitatif berupa studi kasus dengan menggunakan dua metode pengumpulan data yaitu wawancara mendalam terhadap aktivis, saksi ahli, dan penghayat kepercayaan, serta mempelajari dokumen tertulis berupa salinan resmi Putusan MK, dokumen resmi Majelis Luhur Kepercayaan Terhadap Tuhan Yang Maha Esa (MKLI), dan berita online. Temuan riset menunjukan bahwa JR UU Adminduk oleh kelompok aliran kepercayaan membuktikan Upaya Pengongkritan Demokrasi Dahl pada ruang kerja legal. Saluran legal yang ditempuh berbanding lurus dalam mempengaruhi jangkauan kerja inklusifitas dan kompetisi sebagai capaian yang terbatas pada tataran legal. Merujuk pada konteks inklusifitas kasus yang secara administratif termaktub dalam Kartu Tanda Penduduk (KTP) serta mekanisme fungsinya, maka kemunculan gejala kompetisi hanya dapat dilacak setelah kemunculan gejala inklusifitas.

The struggle of citizen right by local spiritual community through the Judicial Review (JR) of the Population Administration Regulation (UU Adminduk) No.23 of 2006 as amended in the Population Administration Regulation (UU Adminduk) No.24 of 2013 has pursued the state sectarian perspective which acts as a religion shadow institution in managing citizenship. JR UU Adminduk which seen as minorithy upheaval at the local level, but contains discourse phenomena that work on a global level, that is the trend of commitment to democracy issues as indicated by the focus of JR UU Adminduk to realization of inclusiveness. Inclusiveness is an important concern in the concept of democracy that Robert Alan Dahl proposed in Poliarcy which consists of two main dimentions, namely : inclusiveness and competition, while the efforts to actualize this two dimentions can be pursued through three efforts among others : 1) citizens must have the opportunity to formulate their preferences; 2) to signify these preference to their fellow citizens and government by individual or collective action; and 3) to their preference weighed equally in the conduct of the government, weighed with no discrimination the content or the source of the preferences. This research is a qualitative research in the case study form by using two types of data collection method, those are in-depth interview of activist, expert withness, and beliefs, then studying the written document of Constitutional Court Decision (official copies), the official document from the Majelis Luhur Kepercayaan Terhadap Tuhan Yang Maha Esa (MLKI) and online news. This research finds indicate that the JR UU Adminduk by local spiritual community proves Dahls Democracy Efforts on legal work-space. Choice over the use of legal strategy directly proportional in affecting the reach of inclusiveness and competition work as a result that is limited to the legal level. Reffering to the context of the case inclusiveness that is administratively contained in the Identy Card (KTP) as well as the mechanism of it function, the appearance of a competitive symptom can only be tracked after the appearance of inclusiveness symptoms.
