EFEKTIVITAS IMPLEMENTASI KEBIJAKAN PENGENDALIAN PEMBANGUNAN HOTEL DI KOTA YOGYAKARTA

Pembangunan hotel di kota Yogyakarta menjadi perhatian serius oleh masyarakat serta para aktivis perkotaan di sepanjang tahun 2012 hingga 2013 yang disebabkan oleh tingginya permintaan perizinan untuk mendirikan bangunan hotel. Urgensitas untuk bertindak disampaikan masyarakat dengan berbagai cara kepada Pemerintah Kota Yogyakarta yang pada akhirnya terjawab dengan dikeluarkannya kebijakan publik berupa Peraturan Walikota Nomor 77 Tahun 2013 tentang Pengendalian Pembangunan Hotel. Kebijakan diharapkan mampu untuk mengendalikan atau bahkan meredam tingginya permintaan akan pembangunan. Anehnya angka pengajuan untuk izin mendirikan bangunan (IMB) hotel bukan menurun namun malah meningkat begitu tinggi hanya dalam waktu kurang lebih satu bulan. Hal tersebut menjadi pertanyaan besar bagi masyarakat kota juga pemerhati permasalahan kota umumnya. Apakah yang menjadi permasalahan utama hingga kebijakan publik pun tidak mampu menahan gelombang permintaan pembangunan hotel. Oleh karena hal tersebut maka penelitian ini bertujuan untuk menggali permasalahan serta menemukan alasan dibalik ketidakefektifan implementasi kebijakan tersebut. Melalui penelitian kualitatif berupa wawancara, studi literatur juga dengan observasi peneliti membaca dan menelaah kebijakan publik ini. Teori yang digunakan untuk mengupas data adalah teori milik Merilee S. Grindle (1980) tentang implementasi kebijakan publik dimana menurutnya ada dua faktor utama yang akan mempengaruhi efektif atau tidaknya suatu kebijakan publik. Faktor tersebut adalah mengenai konten dan konteks dalam sebuah kebijakan. Konten membahas mengenai isi dari kebijakan, sedangkan konteks membahas mengenai lingkungan yang ada ketika kebijakan tersebut diimplementasikan. Hasil dari penelitian ini menunjukkan bahwa implementasi kebijakan publik berupa Peraturan Walikota Nomor 77 Tahun 2013 tentang Pengendalian Pembangunan Hotel berjalan secara tidak efektif disebabkan utamanya oleh permasalahan konteks kebijakan yaitu kekuasaan, kepentingan dan strategi dari para penguasaha hotel yang begitu kuat yang melemahkan posisi tawar masyarakat kota. Kemudian masalah karakteristik dan rezim penguasa, dimana pemerintah kota bersikap dingin dan tertutup yang menyulitkan proses implementasi yang efektif. Ketiga adalah masalah kepatuhan dan daya tanggap. Kepatuhan hukum pihak pengusaha hotel dapat dikatakan sangat buruk dan daya tanggap Dinas Perijinan juga Pemerintah Kota begitu lemah ketika dihadapkan masalah pembangunan yang harus segera diatasi.

Hotel development in the city of Yogyakarta becoming a serious concern by the community and urban activists throughout the year 2012 to 2013 caused by the high demand for permits to establish hotel buildings. The urgency for action submitted by the community in various ways to the Government of Yogyakarta City, which finally answered with the action from the city mayor by issuing public policy in the form of Mayor Regulation No. 77 of 2013 on Hotel Development Control. The policy is expected to be able to control or even reduce the high demand for the hotel development. Surprisingly, the number of submissions for hotel building permits (IMB) is not decreasing at all, but actually increases so high in just over a month. This is a big question for the city community as well as observers of the city's problems generally. What is the main problem that caused the public policy to be unable to withstand the tide of demand for hotel development. Because of this, this study aims to explore the problems and find the reasons behind the ineffectiveness of the implementation of the policy. Through qualitative research in the form of interviews, literature studies as well as observations. The theory used to analyzed the data is Merilee S. Grindle (1980) theory about the implementation of public policy which according to him there are two main factors that will influence the effectiveness of a public policy. The factors are the content and context in a policy. Content discusses the contents written in the policy, while the context discusses the existing environment when the policy is implemented. The results of this study indicate that the implementation of public policy in the form of Mayor Regulation Number 77 of 2013 on Control of Hotel Development runs ineffectively due mainly to the problems of the policy context, namely the power, interests and strategies of the hotel's powerful entrepreneurs that weaken the bargaining power of urban communities. Then the problem of characteristics and the ruling regime, where the city government is cold and closed in responding the protests and aspiration given to them, which complicates an effective implementation process. Third is the problem of compliance and responsiveness. Legal compliance of the hotel entrepreneurs can be said to be very bad and the responsiveness of the Office of Licensing and the City Government is so weak when confronted with development issues that must be addressed.
