AN ANALYSIS ON AN ARBITRATOR'S REPEATED APPOINTMENTS IN INTERNATIONAL ARBITRATION AND ITS RELATION TO CREATING JUSTIFIABLE DOUBTS TO THEIR IMPARTIALITY AND INDEPENDENCE

Penelitian hukum ini berusaha untuk berfungsi sebagai pedoman untuk menilai ajuan pengingkaran arbiter, khususnya yang berkaitan dengan arbiter yang terlah ditunjuk berulang kali oleh pihak yang sama dalam arbitrase internasional dan hubungannya untuk menciptakan keraguan netralitas dan kemandirian arbiter tersebut. Penelitian yang digunakan adalah penelitian normatif. Dengan demikian, untuk memahami topik dan rumusan masalah, beberapa hukum yang mengikat, hukum yang tidak mengikat, literatur, dan kasus-kasus arbitrase internasional diperhitungkan. Hasil dari penelitian hukum ini terbukti dengan mengkategorikan beberapa faktor yang digunakan dalam menilai ajuan pengingkaran arbiter yang berulang kali dintujuk untuk sampai pada kesimpulan bahwa mereka secara obyektif dapat menimbulkan keraguan. Standar keraguan yang digunakan di arbitrase yang berbeda, dan prosedur siapa yang diberi wewenang untuk memutuskan permasalah pengingkaran pun sangat penting dan berpengaruh terhadap faktor-faktor diatas.

This legal research strives to serve as a guideline to assess arbitrator challenges, specifically the ones relating to an arbitrator's repeated appointments in international arbitration and its relation to creating justifiable doubts to their impartiality and independence. A normative research was used in this legal research. Thus, to grasp the understanding and findings of the research questions several hard laws, soft laws, literature, and international arbitration cases was taken into account. The result of this legal research was evident by categorizing the many factors that is used in assessing an arbitrators repeated appoint to come to a conclusion that they objectively give rise to justiciable doubt that would warrant for an arbitrator's removal. The test of justifiable doubts used in different arbitral tribunals, along with the procedure on who is given the authority to decide on the challenge serves a great importance in order to use the factors and play to the objectivity of the challenge.
