Perlindungan Hukum Keselamatan dan Kesehatan Kerja Pekerja Angkut Sampah di Tempat Pembuangan Akhir Tamangapa Antang Kota Makassar

Penelitian ini bertujuan, pertama, untuk mengetahui dan menganalisis arti penting norma Keselamatan dan Kesehatan Kerja jika dikaitkan dengan peran Negara sebagai pelindung warga Negara dan kedua, untuk mengetahui dan menganalisis perlindungan Keselamatan dan Kesehatan Kerja bagi Pekerja Angkut Sampah Kota Makassar. Penelitian ini merupakan penelitian yuridis - empiris. Data yang diperoleh adalah data primer dan data sekunder. Data primer diperoleh melalui observasi dan wawancara. Alat pengumpulan data adalah daftar checklist dan pedoman wawancara. Teknik pengambilan sampel menggunakan purposive sampling. Data yang diperoleh kemudian dianalisis secara kualitatif. Hasil analisis dipaparkan secara deskriptif. Hasil penelitian menunjukan bahwa terdapat 4 gagasan mengenai arti penting norma Keselamatan dan Kesehatan Kerja, yaitu: pertama, setiap pekerjaan/aktifitas selalu ada risiko kegagalan. Kedua, filosofi dasar Keselamatan dan Kesehatan Kerja adalah melindungi keselamatan dan kesehatan para pekerja dalam menjalankan pekerjaan. Ketiga, norma Keselamatan dan Kesehatan Kerja adalah sebuah budaya bukan program. Keempat, norma Keselamatan dan Kesehatan Kerja bukan hanya tanggungjawab pemerintah, akan tetapi juga merupakan tanggungjawab bersama terlebih pekerja itu sendiri. Selain itu, adapun perlindungan yang diberikan oleh Dinas Lingkungan Hidup sebagai pelindung pekerja angkut sampah adalah berupa perlindungan preventif serta perlindungan represif. Adapun perlindungan preventif adalah memberikan pembinaan kepada Pekerja, penyediaan APD, memberikan waktu kerja dan waktu istirahat, penyediaan makanan sehat, dan penyediaan pemeriksaan kesehatan. Adapun perlindungan represif adalah pemotongan upah dan penyediaan kotak P3K di dalam mobil angkutan sampah.

This study aims, first, to know and analyze the important meaning of Work Safety and Health norms when attributed with the role of the State as a protector of citizens and second, to know and analyze the protection of Work Safety and Healthy for Wastehouse Workers of Makassar City. This research is a juridical - empirical study. The data obtained are primary and secondary data. the primer data was gained from observation and interview. The tool of data's collection are checklist and interview guidelines. The sampling technique is purposive sampling. Primer data and sekunder data which is later qualitatively analyzed. The analysis results are presented descriptively. The result of the research shows that there are 4 ideas concerning the important meaning of Work Safety and Health norm, i.e.: first, every work/activities always have failure risk. Second, the base's philosophy of Work Safety and Health norm is to protect workers Safety and Health while work. Third, Work Safety and Health norm is a culture not a program. Fourth, Work Safety and Health norm is not just governments responsibility, but workers responsibility as well. In addition, the protection provided by the Environment Office as a protector of wastehouse workers is in the form of preventive protection and repressive protection. The preventive protection is to provide guidance to the Workers, the provision of equipment of self-protection, provide work time and rest time, the provision of healthy food, and the provision of health checks. As for repressive protection is the wage cut and the provision of first aid kit in the garbage transportations car.
