PEMBUKTIAN UNSUR DELIK PERDAGANGAN ORANG MELALUI JASA MEDIA ONLINE PADA PERBUATAN NIKAH SIRI TERSELUBUNG

Penelitian dalam penulisan hukum ini memiliki dua tujuan yang objektif. Tujuan objektif yang pertama yaitu untuk mengetahui dan menganalisis apakah pemilik situs www.nikahsirri.com bisa memenuhi unsur delik Perdagangan Orang. Tujuan objektif yang kedua yaitu untuk mengetahui dan menganalisis cara membuktikan terpenuhinya unsur delik Perdagangan Orang dalam perbuatan nikah siri terselubung melalui situs www.nikahsirri.com. Penelitian dalam Penulisan hukum ini termasuk dalam jenis penelitian hukum normatif yang didukung dengan data primer. Penelitian ini menggunakan metode kualitatif dengan cara menggabungkan dan menganalisis secara deskriptif hasil penelitian yang diperoleh melalui penelusuran kepustakaan dan penelitian lapangan melalui wawancara. Berdasarkan hasil penelitian lapangan, ditemukan beberapa perbedaan pendapat. Dari analisis hasil penelitian secara kualitatif, Penulis berpendapat bahwa pemilik situs www.nikahsirri.com bisa memenuhi unsur delik Perdagangan Orang, sebagaimana tercantum dalam Pasal 2 ayat (1) juncto Pasal 10 Undang-Undang Republik Indonesia Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang (UU PTPPO) junctis Pasal 53 ayat (1) Kitab Undang-Undang Hukum Pidana (KUHP). Pemilik situs tersebut memenuhi unsur delik Setiap Orang, yang melakukan Perekrutan, dengan memberi bayaran, untuk tujuan, mengeksploitasi orang tersebut, di wilayah negara Republik Indonesia, dalam UU Pasal 2 ayat (1) UU PTPPO. Walaupun perbuatan pemilik situs tersebut belum selesai, pemilik situs tersebut telah memenuhi unsur delik percobaan sebagaimana diatur dalam Pasal 53 ayat (1) KUHP. Kemudian, berdasarkan Pasal 10 UU PTPPO pemilik situs www.nikahsirri.com tetap dapat dipidana dengan pidana yang sama sebagaimana melakukan delik selesai. Cara membuktikan terpenuhinya unsur delik Perdagangan Orang dalam perbuatan nikah siri terselubung melalui situs www.nikahsirri.com yaitu dengan cara menunjukkan minimum dua alat bukti yang sah. Alat bukti yang diperoleh dari hasil penelitian ini yaitu Dokumen Elektronik dan surat. Apabila dilanjutkan hingga ke persidangan di Pengadilan maka dapat diperoleh juga alat bukti keterangan saksi, keterangan ahli, keterangan terdakwa, dan petunjuk. Research in this Legal Writing has two objective purposes. The first objective purpose is to find out and analyze whether the site owner of www.nikahsirri.com can fulfill the elements of the People Trafficking. The second objective purpose is to know and analyze how to prove the fulfillment of the elements of Trafficking of Persons in the act of veiled siri marriage through the site www.nikahsirri.com. Research in this Legal Writing is classified as normative legal research supported with primary data. This research uses qualitative methods by combining and analyzing descriptively the results of research obtained through literature research and field research through interviews. Based on the results of the field research, differences opinion were found. From the analysis of qualitative research results, the Author contends that the owner of www.nikahsirri.com site can fulfill the elements of the Trafficking of Persons, in line with Article 2 paragraph (1) juncto Article 10 of the Law of the Republic of Indonesia Number 21 Year 2007 on the Eradication of Crime of Trafficking in Persons (UU PTPPO) junctis Article 53 paragraph (1) of the Criminal Code (KUHP). The owner of the site fulfills the elements of the offense of Every Person, who commits Recruitment, by paying, for the purpose, of exploiting that person, in the territory of the Republic of Indonesia, in Article 2 Paragraph (1) of the UU PTPPO. Although the act of the owner of the site has not been completed, the owner of the site proven to fulfill the elements of trial offense as regulated in Article 53 paragraph (1) of the KUHP. Further, based on Article 10 of the UU PTPPO the owner of www.nikahsirri.com site can still be punished with the same crime as the complete offenses. The way to prove the fulfillment of the elements of Trafficking of Persons in the act of siri marriage disguised through the site www.nikahsirri.com is by showing the minimum of two valid legal evidences. The evidences obtained from the results of this research are the Electronic Documents and a document. If this case continues to the court with the indictment violation of UU PTPPO, then the testimony of a witness, testimony of an expert, the testimony of the accused and an indication can be obtained.
