PANCASILA SEBAGAI BATASAN KETERLIBATAN KONFIGURASI POLITIK DALAM PEMBENTUKAN SUATU PRODUK HUKUM (Analisis terhadap Pasal 6A Undang- Undang Dasar Negara Republik Indonesia Tahun 1945 dan Undang- Undang Nomor 42 Tahun 2008 Tentang Pemilihan Umum Presiden dan Wakil Presiden)

Penelitian ini bertujuan, pertama, untuk mengetahui bagaimana konfigurasi politik dalam pembentukan produk hukum. Kedua, untuk mengetahui mengapa dalam proses pencalonan presiden dan wakil presiden hanya diberikan kepada jalur pencalonan malalui pertai politik dan gabungan partai politik. Ketiga, melihat bagaimana Pancasila sebagai Filosofische Grondslag atau dasar falsafah bangsa memandang bagaimana pencalonan presiden dan wakil presiden jika hanya diberikan kepada jalur partai politik. Jenis penelitian yang digunakan adalah penelitian normatif. Jenis data dalam penelitian ini menggunakan data sekunder dan data primer. Teknik pengumpulan data menggunakan teknik kepustakaan dan Penelitian lapangan melalui wawancara. Analisis data menggunakan analisis kualitatif. Berdasarkan hasil penelitin dalam pembahasan. Pertama, konfigurasi politik merupakan hal yang wajar dalam pembentukan produk hukum, namun harus diatur porsinya. Kedua, pengaturan tentang jalur partai politik di dalam syarat calon presiden dan wakil presiden telah dikunci dalam Undang- Undang Dasar Negara aRepublik Indonesia, hal tersebut tidak terlepas banyaknya kepentingan politik dalam proses amandemen tersebut. Ketiga, Pancasila tidak membatasi dan tidak melarang proses pencalonan, dan lebih memberikan ruang serta hak yang sama terhadap semua bangsa untuk memiliki hak dipilih dan memilih meskipun harus melalui proses dan ketetapan hukum yang diatur.

ABSTRACT This research aims at first to know how political configuration in the formation of the products of the law. Second, to know why in the process of the candidacy of president and vice president was only given to the candidacy from political pertai band and a group of political parties. Third, see how Pancasila as Filosofische Grondslag or base of the philosophy of the people saw how the candidacy of president and vice president if only given to the political parties line. The type of research that is used the normative research. The type of data in this research using secondary data and primary data. The technique of data collection using the technique of literature and field research through the interview. Data analysis using Qualitative analysis. Based on the results of research in discussions. First, political configuration is fair in the formation of the products of the law, but must be regulated big. Second, the setting of the political parties line in terms of candidate for president and vice president has been locked in the regulations the State of the Republic of Indonesia, it not despite many political interests in the amendment process. Third, Pancasila does not limit and does not prohibit the candidacy process, and more provides the space and the same rights for all nations to have the right to choose and choose although must be through the process and the statute of the law which regulated.
