PELAKSANAAN KEWENANGAN MAJELIS KEHORMATAN NOTARIS (MKN) DALAM PERMOHONAN IJIN PEMERIKSAAN TERHADAP NOTARIS

Penelitian ini bertujuan untuk mengetahui mekanisme pemeriksaan Majelis Kehormatan Notaris Wilayah DIY terhadap Notaris yang dimintakan oleh penyidik kepolisan dan mengetahui dasar pertimbangan Majelis Kehormatan Notaris Wilayah DIY dalam memberikan persetujuan atau penolakan yang dimintakan oleh penyidik kepolisian Jenis penelitian ini menggunakan penelitian normatif empiris dengan melakukan wawancara langsung di lapangan untuk memperoleh data primer dan dilengkapi dengan data sekunder guna melengkapi penelitian. Sifat penelitian yang digunakan adalah deskriptif. Teknik penarikan Sampel yang dipilih yaitu non probability sampling dengan metode purposive sampling. Analisis data dilakukan dengan menggunakan pendekatan kualitatif. Hasil analisis data disajikan secara deskriptif. Hasil penelitian menunjukan bahwa (1) mekanisme pemeriksaan Majelis Kehormatan Notaris Wilayah DIY terhadap Notaris telah dijalankan sepenuhnya oleh MKN wilayah DIY seperti pada pembentukan majelis pemeriksa yang dilakukan tidak lebih dari 5 (lima) hari kerja sejak surat tersebut diterima dan pemanggilan terhadap Notaris yang dilakukan paling lama 5 (lima) hari sebelum pemeriksaan dilakukan sehingga jangka waktu pemberian jawaban tidak melewati batas waktu yang ditentukan yakni 30 (tigapuluh) hari kerja sejak surat tersebut diterima. (2) Dasar pertimbangan penolakan terhadap permohonan penyidik antara lain: (a) Jika prosedur pembuatan akta sudah dijalankan oleh Notaris sesuai ketentuan UUJN/UUJNP, (b) Jika pemanggilan itu tidak mempunyai alasan yang kuat dan jelas apalagi aktanya tidak dipermasalahkan/diingkari oleh para pihak, (c) Jika pemanggilan itu tidak ada kaitannya dengan akta Notaris. Sebaliknya persetujuan akan diberikan oleh MKN wilayah DIY jika (a) Notaris tersebut menjalankan jabatannya tidak sesuai prosedur sehingga terjadi adanya indikasi Pasal 27 Permenkumham No. 7 Tahun 2016, (b) Notaris sendiri bersedia untuk hadir memberikan keterangannya di hadapan penyidik.

This study purposed to examine mechanism of the Honorary Notary Council of Yogyakarta Special Region to the Notary requested by the police investigator and to know the basis of consideration of the Honorary Notary Council of Yogyakarta Special Region in giving approval or rejection requested by police investigator. This type of research uses empirical normative research. This research was conducted by direct field interviews to obtain primary data and completed with secondary data. The nature of the research used is descriptive. Sampling technique using non probability sampling with purposive sampling method. Data analysis is done by using qualitative approach. The results of data analysis are presented descriptively. The result of the research indicates that (1) the mechanism of examination of the Honorary Notary Council of Yogyakarta Special Region to the Notary has been fully implemented by the MKN of DIY Region as in the formation of examiner assemblies conducted no more than 5 (five) working days since the letter received and calling the Notary made most 5 (five) days before the examination is conducted so that the time period for giving the answer does not exceed the specified time limit of 30 (thirty) working days since the letter is received. (2) The grounds for the rejection of the investigator's request include: (a) If the procedure of the deed is already executed by a Notary pursuant to the provisions of UUJN / UUJNP, (b) If the summons has no clear and clear reason, the act is not questioned / denied by the party, (c) if the summons has nothing to do with the Notarial deed. On the other hand, the approval will be given by the MKN of DIY territory if (a) the Notary performs his/her position not according to procedure so that there is an indication of Article 27 Permenkumham. 7 of 2016, (b) the Notary himself is willing to present his testimony before the investigator.
