ANALISIS POLA PROMOSI DAN MUTASI HAKIM DI MAHKAMAH AGUNG RI

2017 | Tesis | S2 ManajemenPenelitian ini bertujuan untuk menganalisis pola promosi dan mutasi Hakim di Mahkamah Agung RI untuk mengetahui kelemahan-kelemahan pola promosi dan mutasi Hakim saat ini dalam kaitannya dengan aspirasi Hakim, penilaian kinerja Hakim, dan kebutuhan organisasi. Selain itu penelitian ini juga bertujuan memberikan usulan-usulan pola promosi dan mutasi Hakim yang dapat memenuhi aspirasi Hakim, penilaian kinerja Hakim, dan kebutuhan organisasi. Metode pengumpulan data dilakukan melalui wawancara dan studi pustaka. Metode pengumpulan data melalui wawancara langsung dimaksudkan untuk mendapatkan dan memahami kondisi terkini menurut hakim tentang pola promosi da mutasi hakim yang saat ini dilaksanakan di Mahkamah Agung RI. Hasil penelitian menunjukkan bahwa aspirasi, penilaian kinerja, dan kebutuhan organisasi belum terpenuhi dalam pola promosi dan mutasi saat ini. Hakim berpendapat bahwa pola promosi dan mutasi saat ini belum transparan dalam hal kriteria atau ketentuan seseorang dipindah ke kelas pengadilan yang sama atau lebih tinggi. Pola promosi dan mutasi hakim saat ini berdasarkan Surat Keputusan Ketua Mahkamah Agung Nomor 48 / KMA / SK / II / 2017 tentang pola promosi dan mutasi Hakim di empat lingkungan peradilan.
This study is aimed to analyze the pattern of promotion and movement of Judges in the Supreme Court of the Republic of Indonesia, particularly to find out the weaknesses of current promotional and movement of judges pattern in relation to the aspirations of Judges, Judge performance assesment and organizational needs. In addition, this study also is aimed to provide suggestions of promotional patterns and movement of judges that can fulfill the aspirations of Judges, Judge performance assesment and organizational needs. Methods of data collection is conducted through interview and library research. The method of collecting data through face to face communication is intended to obtain and understand the current condition according to the judge about the pattern of promotion and movement of judges currently being implemented in the Supreme Court. The result shows that aspirations, performance assesment and organizational needs have not been achieved in the current pattern of promotion and movement of judges. The judge states that the current pattern of promotion and movement of judges has not been transparent in the case of a person's qualification or criteria of being transferred to a the court that has higher class. The transparancy of criteria of Judges to get promotion to the court that has higher class has not yet been cleared. The current pattern of judicial promotion and movement of judges is based on Supreme Court Decree No. 48 / KMA / SK / II / 2017 regarding the pattern of promotion and movement of judges in four judicial bodies.
