ANALISIS EKONOMI PERSAINGAN USAHA TIDAK SEHAT 2000-2007

Penelitian ini bertujuan untuk menganalisis produktifitas KPPU, karakteristik pelanggaran persaingan usaha, karakteristik terlapor (pelanggar), biaya dari persaingan usaha tidak sehat, dan hubungan estimasi kerugian terhadap putusan KPPU. Dengan pendekatan cost of crime dan Ordered Multinomial Models.
Hasil dari penelitian ini memberikan beberapa kesimpulan sebagai berikut: biaya persaingan usaha tidak sehat pada tahun 2007 sebesar Rp 34,4 triliun, dan estimasi kerugian memiliki hubungan positif terhadap putusan KPPU. Selama keadilan hukum belum sama dengan keadilan ekonomi maka kondisi persaingan usaha yang sehat tidak akan terwujud.
This study aims to analyze the productivity of KPPU, the characteristics of competition violations, the characteristics of offenders, the cost of unfair competition, and the relationship between estimate losses and KPPU decision. With the cost of crime approach and Ordered Multinomial Models.
The results of this study provides some conclusions as follows: the cost of unfair competition in the year 2007 amounting to Rp 34.4 trillion, and estimates of losses had a positive relationship to the decision of KPPU. As long as the legal justice not the same as the economic justice, the condition of fair competition will not materialize.
