Analisis Ekonomi Untuk Korupsi Di Indonesia (2001-2008)

Penelitian ini bertujuan untuk menganalisis seberapa besar kerugian akibat korupsi, selisih antara kerugian korupsi dengan hukuman finansial yang diberikan kepada terdakwa, karakteristik pelanggaran korupsi, dan bagaimana pengaruh estimasi kerugian korupsi terhadap putusan hukuman oleh hakim. Data yang digunakan berasal dari Putusan Mahkamah Agung untuk kasus korupsi dari tahun 2001 hingga tahun 2008 berjumlah 484 kasus. Metodologi yang digunakan untuk menganalisis pengaruh estimasi kerugian terhadap putusan hukuman oleh hakim menggunakan Logit.
Hasil penelitian ini menyimpulkan bahwa kerugian korupsi di Indonesia 2001-2008 mencapai 53.43 triliun rupiah. Kerugian korupsi yang dilakukan terdakwa tidak berpengaruh terhadap hukuman penjara, denda dan hukuman pembayaran ganti rugi yang diberikan hakim pengadilan kasasi, di sisi lain kerugian korupsi ini mempunyai hubungan negatif terhadap pemberian hukuman penjara oleh hakim pengadilan negeri. Kondisi ini akan membuat usaha pencegahan seseorang melakukan perbuatan korupsi semakin sulit.
This study aims to analyze the loss caused by corruption act, difference between loss and financial punishment which is given to offenders, the characteristics of offenders, and correlation between estimated losses and punishment by the judge. The data are based on the Supreme Court decisions for corruption cases from year 2001 to year 2008 comprises of 484 cases. Logit method is used to analyze the influence of estimated losses against punishment by the judge.
Results from this study conclude that the loss caused by corruption act in Indonesia in year 2001 to year 2008 reaches 53.43 trillion rupiah. Estimated losses have no influences to the imprisonment, fines, compensation by the Supreme Courts judge. On the other hand, estimated losses have negative correlation to imprisonment by the District Courts judge. This situation will make the effort to deter people to do corruption more difficult.
