Bank Tabungan Negara Persero, Cabang Yogyakarta dan untuk mengetahui konsekuensi para pihak terhadap perjanjian jaminan membeli kembali dalam pelaksanaan KPR di PT. Bank Tabungan Negara, Cabang Yogyakarta. Penelitian ini menggunakan penelitian normatif empiris yang dilengkapi dengan data lapangan. Teknik pengumpulan data mengunakan studi normatif empiris melalui analisa kasus yang terjadi di lapangan dan undang-undang yang berlaku. Data kualitatif dianalisis dan kemudian disajikan secara deskriptif dengan menjelaskan sesuai dengan kasus yang berkaitan dengan temuan penelitian. Dalam fasilitas kredit pemilikan rumah, ada satu istilah yang biasa disebut jaminan membeli kembali. Jaminan membeli kembali sendiri tidak diatur dalam undang-undang hukum perdata namun selalu dipakai berdasarkan asas kebebasan berkontrak yang terdapat dalam Kitab Undang-Undang Hukum Perdata dan sebagai solusi ketika debitur lalai dalam memenuhi kewajibannya. Bank sebagai agen pengembangan dapat memberikan kemudahan dalam pembayaran melalui program KPR dengan cara tunai ataupun bertahap. Jaminan membeli kembali berdasarkan perjanjian jaminan membeli kembali dalam studi kasus ini telah sukses dilaksanakan. Dan berdasarkan konsekuensi hukum dan ekonomi, dari sudut pandang para pihak, para pihak akan menghadapi konsekuensi yang berbeda-beda.
The aim of this research is to find out the implementation of buyback guarantee within sale and purchase transaction of KPR in PT. Bank Tabungan Negara Persero (Tbk.), Branch Yogyakarta and to find out the consequences toward the parties upon buyback guarantee agreement within the mortgage transaction in PT. Bank Tabungan Negara Branch Yogyakarta. This research uses normative empirical research completed with the field data, the field data was used by interviewing the research subject with the questions which is relevant with the case. The qualitative data analyzed and then presented descriptively by describing and explaining appropriate to the case, which relates to the research finding. Within mortgage facility there is a term that is called Buyback Guarantee or guarantee. Buyback guarantee itself is not regulate under Indonesian Civil Code but always used based on freedom of contract principle which exist in the Indonesian Civil Code and as a solution when customer conduct a non-performing loan. Bank as an agent of development to support national development in Indonesia can gives an easiness within the financial transaction by providing a mortgage facility to help people who wants to buy a house. The implementation of buyback guarantee execution according buyback guarantee agreement within this case was successfully conducted. And regarding the economic and legal consequences towards parties within the buyback guarantee agreement, from the perspective of the parties, each of them will facing a different legal and economic consequences.
